    Exclamation storing data for 6 years "APPEALABLE" ???

    since i joined this site the other day i must have been reading for well over 20 plus hours.
    Interesting reading it makes.
    i read a thread on here where the cra admit there is nothing written down in law to set 6 yearsicon as the threashold, but admit its no more than a "AGREEMENT" between relevant parties as this is what it should be.

    So if this is the case then surley any member of the public could have the right in court to challenge this time frame and in theory get things removed quicker ??????

    Just a thought.. or am i wrong in how i have read the info on here.

    on a personal note, its about time the cra paid us for the privaledge of being able to give out our personal info. 8)

    The 6 years is based on the maximum time your able to make a money claim (PI 3 years, Defamation 1 year, Employment ET 3 months) after which it's time barredicon

    But yes it can be challenged particularly where they are disgracefully allowing DCAicon's to effectively re-register debt prior to the 6 years limit thereby blotting your credit file for another 6 years

    So in that case, i guess it would have to be a group action case?

    i say that because the courts if say you or i filed a petition in court to get the 6 yearsicon stopped. They probably just throw it out?

    i can see reason behind cra. But they fail in their duties so many times as proven by the horror stories on here.
    maybe one or two members of here are lying in their cases, but the quanties on here far outway one or two liars.

    also i have question the fact in particular one member of here, he gets his file set to manual retrieval. Yet others who ask the same question are denied this option? Surely this in itself is highley questionable if not illegal.

    But this time issue needs resolving as who has the right to say fred smith screwed up 5 years ago deserves to be punnished ?
    people make mistakes but people learn thats what being human is all about..


    this 6 years does need a good day in court. just a shame i dont have the legal knowhow to start it..


    In theory, how could "ALL" the CRAs be forced into court for the following?

    1. To change the 6 year "AGREEMENT" As its not written into law.

    2. To force a manual "OPT-OUT" clause should someone choose this is what they want. Irrelevant of the reasons for and against such a choice. As at the moment you we all forced to reveal everything.

    3. To force a clearing of a default (while a dispute is going on?) Then reinstate should a dispute fail ?

    4. To stop old debts etc being reissued on your credit file ?


    Food for thought i guess......
