    Default Bought a car from a dealer and has running problems

    Hi ive just bought an american pick up from a dealer on saturday. I paid £9250 For it cash, no finance etc...

    I drove it home the 175 miles on cruise control at 70mph with no noticable problems.

    The car is a 5.4 supercharged so very quick. i though i would give it a bit welly on the way to work to try it out and its running very bad when accelerating. It feels like it is coughing and spluttering so Ive taken it to local garage who deals with all top end cars, and owns one of these pick ups. He said that common problems are coil packs so had a look and all were ok. He noticed the air intake to the supercharger was very loose at both ends so he tightened that up. he also noticed there was some oil there which shouldnt be. So he took it for a quick drive and straight away said this thing isnt 1/2 as quick as what it should be. It felt like it was mis-firing. We got back and put it on the computer, no problems.
    All plugs, coils are ok...He thinks the garage have looseded the air intake and oth ends to reduce the pressure of the supercharger to try and cover up the problem.
    The problem is definitally the supercharger is knakered. Very expensive to replace.

    Now this is where i need some help

    What do i say to the dealer, and how do i do it?
    I either want the supercharger replaced, or can i refuse the car and get my money back?

    Any help, will be appreciated.

    Hi,

    First of all I think you should have contacted the selling dealer before getting anyone else to look at it and carry out any work. I suggest that you contact the dealer and say you beleive the supercharger is faulty but I would'nt mention that you know this for a fact at present. No doubt they will ask you to return it for them to look at. You could ask them if they are prepared to allow you to take it somewhere more local but if they have done what you say they have then they will obviously refuse. Your problem is that under SOGAicon, you have to give the seller the opotunity to rectify the fault so at this stage you cannot reject the car in my opinion.

    Is SOGAicon the sale of goods act?

    Anyone got any ideas of how to put this problem across so i know what im talking about? Like sale of goods act etc....and that ive got to give him the oportunity to fix the car etc....I will ring him and say the car isnt running right and i belive it is the supercharger and see what he says. He might ask me to take it to a local place and then he can speak to the mechanics there.

    If he asks me to take it back down there what should i do? It will cost £40 in fuel to get there, and then when there what would i be expected to do??
    So what should i do if he says the car is fine and had no problems when it left here?

    Ive never had to do this before so dont know how to handle the situation.

    He is a dealer who specialises in prestige/exotic and performance cars so not the usual few hundered quid cars...

    Yes you have to give the seller the chance to do the repair. Who is to say you are not attempting a con with a mate at a local garage.

    It will be their decision to allow you to take it to a local garage.

    Update

    Spoke to the garage who assures me the car was running fine when it was there! He was apologetic and asked me if i could take it to a local garage to have the fault diagnosed and to then ring him. Had it to a garage and has been diagnosed as a knakered supercharger. It cost me £35.25 at the garage to have it looked at. I rang the dealer back and told him what the problem was, and he said i need to take the car back to him so a mechanic he knows can look at it. He wants me to take the car down and leave it there. Now that means i have to drive 160 miles with no way of getting back unless a friend follows me down. Then i am without a car for however long he has my car for, which is obviousley a big inconvenience for me. Also i dont want to spent my saturday travelling up and down the country not to mention it is going to cost me a fortune in fuel.
    Ive priced the part and it is £3445 + VAT and then fitting ontop of that. The car was bought for £9250, so the cost of repair is nearly 50% of the purchase price.

    I sent him a letter by recorded delivery with photographs of the parts cacked in oil and also the price of the parts/fitting etc....

    Ive said that i would prefer the car to be fixed but cant see him agreeing to to pay over £4000 to fix it, so suggested it would be better for all parties if i returned the car on saturday for a refund.

    Where do i stand with compensation as in that ive had to spend £35 at a garage under his instruction, and then what ever it costs me in fuel to get down and back up?
