Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Sorry to make your aquaintance under such circumstances but Im really hoping someone can help me.
A few weeks back I recieved 2 letters from the above company. The letters said that they were pursuing a debt owed to my old bank. Having read a lot about them and also about the situation I am in, I thought I had discovered that the debt was statued barred. As a result of this, I sent them 2 generic letters that I got off of the national debt helpline site, stating that the debt was statute barred. I expected to recieve a reply telling me that that would be the end of the matter.
However today I have recieved a letter telling me that the debt is not barred because they claim that I made a payment to it in October 2005. I am 99.9% sure that I never made any payment to the debt at that time or any time since then.
They are now demanding full payment and my fiancee is at her wits end as we dont have anything like the kind of money they are after.
Now I know enough not to phone the company but I do not know how to proceed.
I would really appreciate any help/advice that anyone is able to offer. Thanks in advance for any help
You need to ask them to clarify how this payment was received.
It has been known for payments like these to appears on statute barred accounts
Dear xxxxx.
Thank you for your letter dated xx/xx/xx.
I have checked all my financial records and cannot locate any payment made to capquest or xxxxxxxx on or around October 2005 regarding the alleged debt.
Please can you forward me the following details:
What date the alleged payment was received?
How the payment was received?
Also can you confirm any name , bank account number, sort code, Post office associated with the alleged payment?
The total amount of the alleged payment?
Any any other details that could identify the source of the alleged payment?
I look forward to your detailed response.
lets see how quicky they answer that
