a friend has received letter stating PPI will be refunded if they sign new loan agreement...
they have loan and it has arrears... do they need to sign new agreement or can they insist on refund and continue with current loan with PPI removed even though they are in arrears....
what are Barclays allowed to do in this circumstance????
This suggests the bank may not have an enforceable credit agreement.
You don't have to sign a new loan agreement. If you want the refund to be paid direct, give them a warning lba and, if nec'y start court action.
They could agree to refund voluntarily but set it against the a/c balance.
The best way to avoid this, and to make sure you get the best refund you can, is to seek repay't of the PPI plus interest in restitution at the bank's contractual rate.
