I have today received a summons for the remaining installment of my council tax plus "costs" of £55, with a court date of 16th March.

 

I am waiting to hear about a council tax benefit claim, which they acknowledge receiving on 4th January.

 

My first thought is to contact the council and point out that we do not know the amount I owe them until they calculate my benefit entitlement, so the figure stated in the summons as being payable cannot be regarded as accurate.

 

Is there anything I haven't considered?

Unfotunately they do know how much you owe - you owe the amount which is currently oustanding. Case law has already determined that a benefit claim is not a legitimate defence against payment of council tax and that normal payment and recovery action continues until such point as there is a zero balance on your Council Tax account.

Out of the blue, the council wrote before the court date saying there has been an irregularity in their recovery procedure, the summons has been withdrawn, and the £55 charge cancelled.
