Letting Agency Backs Down on Pre-Dated Rent Agreement
I signed a pre-dated rent agreement on 17 January 2010 and its commencement date would be on 15 February 2010.
I paid a monthly rent in advance of £1040, a deposit of £1040 and adm.fee of £250.
Today, just one week before the day I could move in, the agent call me by telephone and told me that unfortunately the landlord cannot rent me the flat because the current tenants decided to continue living there.
I protested and I said that I waited almost 3 weeks and I already gave written notice to my landlord saying that I will move out from my current flat.
Then they call me back and said that in order to remedy the situation the Landlord offered another flat in the same building and it is already available. After visiting the place, I agreed to exchange for the new flat and, after I having said that I want to move immediately, the agent said that I could sign the new contract right tomorrow and that I could return to my home and he would call me by telephone after two hours and confirm that “everything is OK”.
However, he did not call me. I telephoned to his office but the person who attended me told me that he was not in the office. I asked him about my situation. He said that everything is fine for signing the new agreement but they will be ready to sign it only on the next Friday.
If the flat is available why they postponed the signing of the agreement to next Friday instead tomorrow ?
And why they did not send any letter about the TDS situation of my deposit during the three weeks that already passed ?
I also noticed that unlike 3 week ago, when I visited the letting agency office for the first time when all 15 desks were occupied by employees, in the last visit only two desks were occupied ! Furthermore, they said that the original agent who signed the agreement on behalf of the landlord moved to another branch of the company. Something is going on !
What I suspect ( though, of course, I am not sure ) is that the letting agency is about to declare bankruptcy and they are postponing and maneuvering to gain time, close their business and keep my money.
Please I would be grateful to any advice on what should I do.
