change of contract from employed with benefits to employed with no hols sick etc
Hi there,
I just need a bit of advice for my hubbies situation.
He met with his boss the other week, who told him 1st march we are changing your contract, taking away your car allowance, hol pay will be built in your item pay no cik pay if no work then no pay. Yes we will still sort out your tax and insurance and it actually works out better for you. ( Er I don't know how all his security will be gone). My hubbie said what if I don't want that and he said their is no ultimatum. My hubbie has worked for them for 9 ears and had an injury at work he has just had 1 op and is due another one in March which he has to have 4 months off work? Is he tring to get out of paying him sick pay which is only 4 weeks anyway even though this was done at work. And can he refuse to change his contract and ask for redundancy? He is a bit of a softie and doesn't know how to write this in a letter which he has told he has to do. I personally think they are cheeky bar stewards and am fuming.
Re: change of contract from employed with benefits to employed with no hols sick etc
Your hubbie should ask his boss to put all these proposed changes in writing because he'll need to get advice before responding to them. (Best practice would be for them to do this before making any changes to his contract anyway.)
hol pay will be built in your item pay
Rolled up holiday pay is unlawful - but don't let on that you know that yet.
Re: change of contract from employed with benefits to employed with no hols sick etc
yes thank you they sent him a really basic e-mail titled "New Rates", anyway I have just replied back declining and telling them he will take redundancy. Have just seen that they have not been paying him the correct holiday pay. He has only been taking 22 days a year and new law is 5.6 weeks now.
And yes i will hit them with that rolled up pay when we see wht they offer him for redundancy!!
