    Default Barclaycard PPI

    Hi Everyone,

    I am pursuing a claim against Barclaycard for miss sold PPIicon on my credit card. The card is still valid and my balance is -£0.75. I sent a Subject access requesticon and received the following. The documents refer to CPR (Civil Procedureicon rules) etc. It is obviously a standardised letter as page 2 refers to sum outstanding of which there is non. The third and fourth sheets are a Barclaycard conditions of use and a blank application? I plan to claim the PPI which i have paid as I believe i was miss-sold the Policy as I believed it was part of the contact in order to obtain the card in the first place.

    any advice would be greatly appreciated.

    Today I received a letter from Barclaycard containing terms and conditionsicon. On my original letter to Barclaycard I sent a full subject access requset and enclosed a £10 Postal order. On the first letter attached to this post they refer to Section 78 of the Consumer Credit act 1974, It also states that "The CPR does not confer an automatic entitlement to Documents before Proceeding start" am i being fobbed off, because surely under data protection they should include all my data, that is what I have been led to believe after trawling posts on this forum? Has anyone any experience of this because your help would be much appreciated.

    Update, today I received a letter stating that Barclaycard state "HAVING REVIEWED YOUR COMPLAINT I FEEL THERE IS A LACK OF SUPPORTING EVIDENCE TO CONFIRM THAT THE SALE OF PPIicon WAS CARRIED OUT IN ACCORDANCE WITH OUR STANDARD PROCEDURES" it goes on that I will be offered an amount, which calculates back to 2004 and then upto the present. I've replied with a letter, not accepting the offer as I've had the card since 1994 and the balance was well in the thousands in the late 1990's, its a waiting game, fingers crossed.

    An update, case referred to fosicon as Barclaycard state that I cannot show evidence that I was paying PPIicon and said they would pay me an average of £6 per month! I had challenged this and said that they had sent me paperwork showing I had a balance of £5000+ in 2002, they rejected this and so I have sent the paperwork to FOS to see if they can help as I had PPI since the card was taken out and PPI was paid on all those payments. I shall wait and see.
