Problem with getting charges back- anyone know the law?

Ive been with Lloyds for years and fell on hard times when work dried up and have been on partial benefits for a while. All that while Lloyds have made various charges to me for going over my overdraft and also bounced DD fees.
I have been told that all bank charge refunds are on hold at the moment as the court case is going through UNLESS you are in financial hardship.
I went through a well known debt advice website and wrote several letters to Lloyds stating i am in financial hardship and have been on benefits and they should not have been charging me fees and taking it out of my benefit money. I have asked for approx £1000 back in charges and marked all of these on previous statements going back 5 years.
Lloyds TSB wrote back to me stating that the court case is now over and it was ruled the charges are fair and therefore I cannot get my charges back.
