I took out PPI with an Abbey CC some time ago.
I ticked the box on the Application Form does this affect my position to a possible claim.
I'm in full time employment and have been for the duration of having the CC.
Being crippled financially at moment due to interest rates in excess of 25%.
Looking for more ways to fight back.
Is it worth spending the £10 to see if I have a claim ?

The last link is full of other links to a lot of the relevant issues on PPI reclaiming and the regulatory bodies etc etc a lot of homework but worth the effort.
My claims so far on bank charges and PPI have managed to get me in excess of £21k back.
So read up, send your SAR if you need to, prepare you case, put in your claim and let the fos adjudicate. The FOS have upheld 90% of claims in favour of the Consumer making the claim.

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

A single £10 fee by postal order is all that is required to obtain all the data held on you by Abbey.
Once information is requested is it easy to identify PPI being added to an account that wasn't asked for ?
You will needto scrutinise all the paperwork you receive to check for the PPI details.

You will need to double check as you state you ticked the box you should have been made aware of all the relevant issues on the policy by virtue of a demands and needs questionnaire, This should have been carried out by abbey staff to ensure the PPI on the CC was in fact suitable to you in line with your position.
You should always receive a copy of the consumer credit agreement with a copy of the terms and conditions that are applicable to that agreement.
If you believe you have been mis-sold PPI then you should submit a claim to ask for the PPI premiums to be returned with 8% statutory interest.

If I did fill in some sort of Q&a will they have a copy ?
Will they have to produce it as part of the SAR request ?
If they don't have this information does it then fall into mis-selling ?
