Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I am in the fortunate position that I had all my statements for the last 5 years, so didn't have to go through the first process that so many of you are having hassles with.
I wrote to Clydesdale (Neil McKirdy, customer relations manager) on 1 August detailing all the charges, and reasons behind them, and received a letter today, dated 14 August, with a cheque attached.
A lot of blurb on it, and legal jargon, but basically he says that, if I cash this cheque, it is in Full and final settlement of my claim, and it is 'tendered without admission of liability'.
Unfortunately, the cheque is only for half of my claim! Should I threaten further action, or cash the cheque, wite back to him saying 'thank you for the first instalment'.
My claim was for £498, he's sent a cheque for £249.
I know a couple of people are in similar situations, as I've read their threads, but can't remember who it was - sorry!
Any advice or help would be appreciated - do I cut and run, or hold out for more?
Don't cash it,send it back and say you require the full amount as you have already discussed and the next stage will be,lba then court -you will get YOUR money back.
