Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
This is a bit of a strange one folks and if it is in the wrong section feel free to move it. I am still waiting to get the exact dates but the dates given a correct in timescale if nothing else.
I have been with the Bank of Ireland for about 20 years, during this time I have never been overdrawn. Because of their unwillingness to give me a direct debit card I in august set up a basic current account with the Co-operative bank. I had my wages transfered to the new account right away but I never transferred my standing orders or direct debits to the co-op until approx 1 November (At this point there was approx £800 still in the bank of ireland account - enough to pay approx 1 months of direct debits etc.) By approx 18 November there was still no direct debits set up in my co-operative account so I rang them. They told me that they has recieved my transfer form on the 3rd November but due to weather and subsequent staff shortages they had not actioned it yet but would do so within a week or so. By December a few direct debits were starting to be set up but I also started to get letters from the Bank of Ireland to say that direct debits had been returned due to lack of funds....(I then paid these directly by debit card to the relevant institutions).
Today i got a letter from the bank of ireland to say that the co-op bank has asked for my account to be closed but they are refusing to do so because they say that I am £330 overdrawn. I can only assume that because i never had an overdraft that this is fees for returning direct debits etc.
So what do i do? I do not wish to pay the BOI the money but i dont want them affecting my slowly improving credit rating and/or adding more charges. Do I have any action I could take against the Co-op bank for the length of time taken to complete my banking transfers? Do i try to reclaim charges against the BOI?
