Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Hi
Having read so much about refunds of charges, I thought I'd do the same.
Prepared the letters in sequence then posted the 1st one in which I asked for a copy of all statements for the last 6 years.
Sent it to A & L BUT not by recorded delivery (doh!) & enclosed a postal order, the stub of which I cannot find (double doh!!)
Needless to say, the 40 days were up at the weekend & no statements.
Can anyone advise on what I should do? I am very tempted to re-send the request but don't want to waste £10 if it's likely that they will turn up late.
Hard to say on that one. You can get a certificate for proof of posting without the expense of recorded delivery, but it is easy to be wise after the event. There is a good chance they had the request so I guess you could send an lba saying that you will take them to court if statements aren't sent in 7 days. Trouble is you wouldn't have any evidence so in reality it probably wouldn't be a good idea to do it.
This demonstrates how important it is to be organised with your paperwork as you will need to do a court claim to get your money back. Might be best to bite the bullet and start again.
When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.
Should you be offered help that requires payment please report it to site team.

Hi
Sent prelim request for payment & included schedule of charges on 31/08/06.
Got this letter today in response...
Dear Mr & Mrs B
I am writing in response to your letter dated 31/08/06 which has been passed to me for reply.
Naturally, I was concerned to note your comments and I will now try to clarify the situation for you.
Initially, I note your comments with regard to the charges that have been applied to your account in that you feel that these are unfair and a method for profit making. I can confirm that A & L invest large sume of money in the technology to be able to not only set up and accept direct debit payments but also return them and notify customers that a Direct Debit has failed.
Furthermore, A & L has a range of great value current account products offering market leading rates. We believe our charges are reasonable, competitive compared with the industry and are clearly shown within our literature and on our website, as well as being set out on our current account statements.
In the circumstances therefore, whilst I appreciate your comments, the situation remains that the charges were raised correctly, in accordance with our tariff. For more details of our tariff, please refer to the reverse of your quarterly statement or view the information on our website at www.alliance-leicester.co.uk
I hope we will now be able to draw this matter to a close and if I do not hear from you within the next 8 weeks, I will assume this is the case. However, in accordance with the regulatory requirements, I am enclosing our leaflet which explains the steps you would need to take if you should wish to pursue this matter further, including the ultimate availability of the Financial Ombudsman Service.
Yours sincerely

My questions now are...
Any ideas why this response to my prelim req is so different to the majority in which they claim that the ruling relates to credit cards?
