Thread: Lisa v's Barclaycard

Hi Peeps,

well, after my MCOL's with HSBC and Natwest, i am ready to take on another so Barclaycard here I come!

Sent my S.A.R - (Subject access request) 09/08/06 and received computer printout of statements going back to may 2004 with the popular letter rambling on about Microfiche and how i am not entitled to the info under the data protection act but they will supply them at £3 per statement bla, bla, bla.

Replied today via recorded delivery telling them to send them or I will estimate the unlawful charges.

I'll let you know what happens next.

Gotta go peeps, need to fax Breakdown of charges to DG solicitors for my HSBC claim.

Well, I wrote and estimated the charges. I worked out the average monthly charge and multiplied it by the number of months missing from my SAR. I received a reply saying they had credited my account with the difference between the charges and the £12 fee recommended by the OFT but only as far back as May 2004. Any charges before that (which were the estimateed ones) were not even mentioned. I have now sent an lba and I have reminded them that I will be adding to my particulars of claim that they have so far failed to provide me with details of charges prior to May 2004 as requested hence the reason the figure is estimated. Let's see what happens next.

Received another s*d off letter as expected. Will now be filing an MCOL with estimated charges. This should be interesting! Anyone else estimated at MCOL stage?
