Just bought old used car - already having problems?
I purchased an "L" Peugeot last Thursday. I bought it from a private trade dealer with a VAT number advertising in a local paper. When I paid the deposit he said he wanted to take it to his local garage first to have it checked over before I drove it away just to make sure everything was ok and safe for me to drive which meant I could'nt pick it up till the following day. It was MOT'd on the Tuesday so I thought this was a little strange??? When I got the car home (20miles away) I took it straight to my mechanic to look over and he says either the head gasket has gone or there is a crack in the main cylinder head as the car is overheating? The engine was also totally overfilled with very clean oil! Is there anything I can do - Can I return the car and ask for a refund?
Re: Just bought old used car - already having problems?
You need to make clear if this is a dealer or private, there is a whole world of difference and if affects the action you can take.
You say he has a VAT number, do you have the sales address?
If this is a legitimate dealer, then take it right back to him with a letter, (it must be in writing), and reject the car under the sale of goods act as not fit for purpose siting the fault. It will be up to the seller to prove there is no fault and not for you to prove there is.

Re: Just bought old used car - already having problems?
I have a used car invoice which has his name/address/vat number although I'm not sure if this is his sales address. When I found the phone number in the paper it has a (T) for trade against it. He is definately a dealer although selling from his house as he had 3 cars in the paper last week alone. Do you suggest I phone him first and discuss? How long do I have to do this.

Yes by all means give him a ring if only to see his reaction. He may be very amenable and say ok bring it back, not problem.
Time is the major factor here, so do it as soon as possible.
I am going to send you a pm freckles with a couple of questions.
