    Talking Charges from Microfiche! Get them!

    Morning all,
    I have had a brainwave after receiving the microfiche letter yesterday!

    I logged into my online bank details and searched all available CHQ payments.
    Then, any that were made after the 18th of a month (Usual pay by date) I have added them into my claim. This gives me back to June 02, therefore will only have to apply for June 2001 - June 2002 statements from the BurK lee Card!

    DeeDee73 or anyone else? Im trying to check my Online Barclaycard Account and I acnt find anyway of searching for these charges ie "searched all available CHQ payments"

    Could you tell me step by step. Are you sure this is barclaycard - I can only view the past 5 months statements.

    Im in a bit of a dilema I submitted my lbaicon to barclaycard on the 14/08/06 so I should be filing my moneyclaim claim on the 28th but I still dont know what my charges are...
    This is the lettter I sent to them

    "Dear Sir/Madam,

    I am very disappointed that you have failed to comply with my letter of the 24/07/06. You have had 3 weeks to respond to this letter and you have done nothing!

    I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debiticon refusals, exceeding overdrafticon limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations.

    I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

    I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I am utterly disgusted the way you have treated me with regards to requesting statements of my account. A Charge of £192 to get a few pages sent to me.

    I require repayment in full of all charges made against my account since june 2000. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest
    plus a claim under ss.7 and 13 of the Data Protection Act 1998 plus my costs and without further notice.

    Furthermore, I shall submit a Consumer Credit Act 1974 complaint to the OFT upon the basis that you have failed to comply with the OFT's direction of 5 April 2006 and are therefore not a 'fit and proper person' to hold a consumer credit licence under the 1974 Act. If you do not understand what this means then seek advice from your legal department.

    What should I do if I dont have the records in time??

    Barclays - Success. Total £3000.
    Barclaycard - Success. £2500
    Barclays Brother - Success £500ish
    Vodafone - Default removal + claim for distress. Settled default removed = £1000 in compensation + £120 court costs paid.

    I didn't check my Barclaycard online, I checked my bank account online, then, any chq payments that came out after the 18th of a month, I have classed as late payments to Barclaycard, as they are the only ones I write cheques for!
    It's just away around the paying for more statements, I have just sent my second letter requesting data, then if I have the basic, sorry no letter i'll be making the claim estimated with the help of my banking account online!

    I have two years worth of records "come to £450 in charges" I think I'll just multiply by 3.

    yep, Multiple by 3. that''s what I am doing and it's up to them to supply evidence if they disagree. If they would have complied in the first place an estimate wouldn't have been necessary. they won't get away with stalling tactics from me.

    only trouble with the x3 est is that I know that those missing yeard were worse for late payments, so I'd be letting them get away with a lot, So I've ggot to get the proper figs, nearly there!

    Barclaycard - Data Protection Act req sent 3rd August, received copy statements and Microfiche garb on 11th Aug.
    2nd letter Data Protection Act req sent 15th Aug. 7th Sept recieved "As explained previously"letter.
    09th September Req for Repayment sent £628 in charges + £152.90 interest = £780.90
    missed something!
    19th October, recieved offer of £166, which they paid straight onto account!

    Next on the List Lloyds TSB - have to open another Bank account first!
