    Default Woolwich/Barclays claim

    Just received my bank statements for the past 6 yearsicon only took then 10 days with is not too bad. All my statements came from BARCLAYS DATA PROTECTION along with the following letter stating copy statements are free of charge

    Dear Mr & Mrs L

    I refer to your letter of 9 March, which was passed to me for comment due to your mention of the Data Protection Act.

    The requested copy statements are enclosed and these are provided free of charge.

    As regards your mention of "manual intervention", could you please explain what you mean by this term and in consequence which records you believe may be of interest to you. In general terms however I can advise that under the Data Protection Act you are entitled to a copy of the material held across the Bank that qualifies for disclosure as your "personal dataicon" - this is known as a data Subject access requesticon. To initiate the process Barclays will require payment of a £10 fee per individual which should be provided by cheque, payable to Barclays plc, directly to this department. Upon payment of the fee(s) the relevant information will be supplied as promptly as possible

    have also totted up all the unpaid dd charges, overdrafticon adminicon fees, auth overdraft fees and god did i have a shock
    £1,585.45 with interest that brings it up to £2,158.26

    should i request a refund including interest or is that pushing my luck too far. any advise

    No, you only request fees with interesticon on top once the matter has gone to court, prior to that, you only claim for fees.

    Someone else may explain this better than me!

    I think the consensus is:

    In your first letter (requesting refund) you claim for ALL charges (as opposed to fees) levied to your account, and ALL interesticon levied to your account as a result of these charges. Technically you should work out what the actual interest is, but as the bank won't give you a Breakdownicon it is easier to let them argue the toss.

    Once your deadline expires, and you notify them that you are issuing a claim in the courts, you then let them know that you will be claiming for:

    FULL refund of charges
    FULL refund of interest (adjusted if the bank has provided an acceptable figure)
    Costs (court costs usually)
    Interest calculated at 8%APR

    Most of this is in the FAQs, but this is a condensed version as it seems to me.

    my bank received my first request letter to day so the 14 day countdown will start monday

    forgot to mention before when they sent me all my statements they where held together with a big bulldog clip, should i return it before i get charged for it

    good thinking about the bulldog clip! However, I think you are being very lenient on the banks... why should the clock start ticking on Monday when they got your letter today?? You can bet your boots they will be charging you for any interesticon on your overdrafts over the weekend!
