Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
We have had a long battle with the HFC, ever since my wife took out a secure loan - even though she does not have a mortgage and is not named on the mortgage deeds. (Basically HFC told me to sign, because we lived together!)
I complained about that and the response was don't be silly, we wouldn't say that!
When we fell into financial difficulties the account got into arrears. Mainly due to HFC trying to take the money before my wife is paid - they set up a DD rather than variable date STO; as she get paid on the last Wednesday of the month. You'll agree it is very annoying to firstly get a bank charge & then to get a letter & phone calls demanding money.
Once we got this sorted out everything is fine - payment goes out the last Wednesday (Dec 30) and yesterday 15th January, I get a call from Joshi in a call centre asking for a payment of £222.28 - I told her to speak to my or my wife, so she rings her on her mobile.
Firstly my wife has told HFC on numerous occasions NOT to call me at work & NOT to call her on her mobile.
Today we get a call at home from 0121214407, call is ignored as it is not a number we know. And in his messge on the answer phone he gave his name Mike and asked us to call back. He failed to give his company name or reason for calling.
So we have had enough with phone calls and are issuing the telephone harressment letter AND the withdraw of Consent under s.10 DPA.
We have no idea WHY they are calling us, they wrote and said we owe £222.28 yet we are paid up to date. Is this something to do with their system that it only reckonises the original loan payment date & not any subsequent changes? My wife will be paying the £222.38 on 27 January as per the agreement started some months back.
We honestly thought that now they are part of HSBC things would improve, but they haven't.
mainly because HFC departments dont talk to each other, to be honest I would for now ignore any attempts to get in contact with you, if it was important enough they would soon send a letter
