Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
This morning I received a letter from my credit card company Amex stating that they had reduced my credit limit .
I contacted them to be told that my account was fine and that there were no problems with it,however my credit limit had been reviewed because they has received info from Experian.
I rejoined Experian on line again as I had cancelled my subscription last September.I was astounded to see a new creditor called Cabot Finance had appeared and has raised a default notice in the sum of 11K.
I do not have any outstanding debts and my credit score was excellent
I have raised a query with Experian and I have also requested them to mark the file "I have never entered into any contract with Cabot Finance and they have no jusistiction in any of my affairs and no right to report on my experian credit file"
I also phoned Cabot Finance even thought I have never had any correspondence with them and asked them re the default notice on my credit file.Eventually after I had no choice but to give them some of my personal details they confirmed it was something to do with Egg banking.I have never had an account with egg
They have a file for someone with a similar spelt name to mine and my address .I told them obviously they had missed linked two or more credit files.I have never ever received any correspondence from Egg or Cabot Finance.
Cabot are now asking me to fax to them my ID and signature.Which for security purposes I am not keen to do.
My question is what should I do next.The default is not mine but it is on my credit file and I need it removed immediately.
hi,
perhaps it will help;
you have few optins but it's catch22:
1)
as i read in another post on this forum you can write to experian that you have raised the concern with them over disputed data hence they have included incorrectly wrong data in their report and it is their responsibility to keep it updated/investigate it/stay in touch with the lender if you requested to do so;thereby you give them 7 working days before you will send a letter before action straight to the court for compensation and removal of the data
<heard it works>
As i mentioned, if you asked experian,or any other credit check agency to act on your behalf and contact the lender and the lender did not contact them, experian should remove the info from their file (though god knows they may reinstate it again)
2)contact cabot again and ask for SAR, you will know where exactly did they take info from, they re obliged to do so under DPA
3)if this is a totaly false entry and you don't recognize it there can be possibility of fraud and you may contact the police (id theft) and CIFA; but I also heard that once you lodge with CIFA it may slow checking process of potential lenders...
Sorry I could not help any other way, but if I find any more info -will share...
