I have just received my annual statement from Egg regarding my loan.
This must of slipped my attention as i thought i had no Protection on he account but it shows that i have
Date of advance 10/jan/05
10169.00 Cash Loan
3342.96 Repayment Protection
84 months
This loan was drawn after a refusal to increase my credit limit on my egg card
Should I be pursuiing them in relation to missold PPI and possible unlawful penalty charges on the credit card prior to clearing and adding that into the loan.
Would the validity of the loan credit agreement also come into question?
Hi thesecret,
Absolutely on both counts. Lot's to examine here so you'll need all of the paperwork in order to post it up for review.
PPI - May not be relevant to you, may have been added without your knowledge, may be excessive/disproportional etc.
Loan Agreement - We need to see it in order to ascertain the numbers are correct, APR within tolerances, correctly executed, prescribed terms complete.
May be tricky to tie the fact that you have an increased loan debt total due to the fact penalty charges were added to an earlier credit card account, not sure how that would work. Best to concentrate on the simple things first by getting a copy of the loan agreement.
They may be unwilling to provide you with paperwork governing the credit card agreement as (I presume) it's now closed. A Subject access request should provide you with what you need.
Maroon, probably a good idea as could be a good example if it turns out to be inappropriate PPI for example. We can handle the other matters as an additional factor.
The secret, would advise agreeing to Maroons request
HI,
as I am in the middle of a long battle with Egg over same thing I would advise you to not mess about and go to the FO.
I had many conversations with Egg re PPI and they get very nasty when you ask for it back. so if you have the paperwork send them a request for a copy so they think you dont have it. send you letter requesting the return of Ppi wait for their responce and submit you compalint to the FO.
Get a good book to read as you will be waiting some time for this to be reolved.
Good luck
Please except my sincere thanks for any help... Knowledge can be dangerous but experience is priceless!
received dsir pack today will comb thru and put links to agreements
They have included everything it seems over 250pages to look thru
All agreements seem to have protection insurance
Get back to you soon
Heres the update, i went direct to Egg thinking what have i got to lose regarding the PPI.
Met with a stonewall, not interested, only interested in collecting there payment.
Account passed to Fredricksons who were informed verbally and in writing regarding this dispute.
Advised verbally although not put in writing that they would note file and wait for advice from client (egg)
Received warning from Bryan Carter and Co regarding outstanding amount.
I have now received a claim form from Northampton county court from Bryan Carter relating to Egg.
As i have been away i just managed to get the AoS in to court but now need some advice as to my defence. I have indicated that i will defend the full amount of the claim
A link to the claim form is below. http://i495.photobucket.com/albums/r...rtformcopy.jpg
Any help will be gladly received.
Also, any chance of re-scanning it, perhaps into .pdf format so we can view it on a larger scale...will be important now its going to court.
Initial suggestions would be to send Carter a cpr request for copy documents and go from there trusting they are insufficient/invalid and he won't disclose.
Can then proceed with next step of cpr and get the court to order disclosure under threat of an unless order or similar, perhaps even get the claim struck out.
