First post on here and hope there is someone out there that can help me with my issue.
In 2003 I bought my first house and as we all know buying a house means home insurance, Life Insurance, total mortgage policy etc. I was in the forces during this time and got out in 2006. I have since been working abroad as a security consultant in hostile areas. Three months ago I moved to a new and bigger house seeing as I had a good income coming in. Three weeks ago I was in an incident and was shot. Luckly I was only hit in the leg but that put me in a position where I could no longer do my work and had to be medivac back to the UK. I've been back for three weeks and it has given me time to start my claims process.
1) I have Critical and illness policy, where I was told that I don't qualify for because I'm not critical nor dead. (I thought thats what Life Insurance was for!!)
2) I have Total mortgage where it states that if the policy holder becomes unemployed the bank will cover the mortgage payments.
3) A Family Income Life Plan, where should I die, my family will recieve a monthly income for the duration of the mortgage.
4) Life Insurance.
My issue is this...... Through out all the years, I've asked on many occasions that because of my job, am I still covered? I have been told yes all times. Since I have been back in the UK I have looked through the T&Cs on all these policies only to find out that they wont pay out if "The policy holder is in the armed forces, a member of the armed reservists, works in a war or a HOSTILE environment"
For years I've been paying these policies on my old and new house and to find out that I wasn't even covered for anything.
Would I stand a good chance of claiming all this money back??

Been looking into it even more and after looking carefully at the T&Cs of these policies, it also goes on to say
"We will not pay a claim resulting from a life covered dying, being diagnosed with a terminal illness or suffering from a critical illness which arises as a result of that life covered serving as a member of the Armed Forces (including the Reserve Forces) in war, invasion or hostilities (whether or not war is declared). In that event, the plan will end and we will repay any premiums paid up to that point. If your plan is a mortgage related plan, this exclusion will not apply"
The policies that I have are:
1) Family Income, (this has nothing to do with the mortgage)
2) Decreasing Life Cover Plan, (critical illness, life cover in one)
3) Total Mortgage, (this obviously has)
Does this mean that I can't make a claim against the bank for Misold Policies??

With all the fiasco that I'm having with the missold policies I thought that I'd give you a sit rep.
Firstly, I want to thank all that helped me in getting me started on this process and currently the fos are looking into it. I also had a chat on the phone with the bank manager the other day to see what they would say. To my amazement, they agreed that I was not covered because of my work but rambled on that it is good to know that my family is covered should I get run over by a bus in the UK (think he moonlights as a comedian!!!) I then reminded him that it was he who told me on three occasions that I was covered. I then let him know on what my actions are. He said a quick thank you and hung up. (hope thats a good thing for me)
I have also started a process with regards to my credit card. I took it out in Dec 2002. So far I've sent them a Subject access request and they've sent back some details but not the main one...... The original signed, executed credit agreement and any terms and conditions that applied to the account.
The only thing they sent was a Credit Card Application which as we know has nothing on it. What they do say on the heading letter is "The Data Protection Act provides individuals with a right of access to their own personal data. Your information may also contain personal data about a third party. If they have not received their consent, they will not disclose my data as this would be a breach on confidentiality to that person"
I have been talking to a friend and he told me that the banks would do this to put people off in hope that the customer would give up on their claim and carry on with the payments, because the banks know that they are in the wrong

What would be my next step from my last post with regard to my crerdit card?? I've again been advised to cancel the payments and should the bank get back to me then to take them on as they don't have the relevent paperwork to demand the monthly charges.
