Hoping I`m in right place not too sure what i`m doing yet, my hubbie suffered a brain injury and can no longer deal with anything he as debts to 5 creditors started a debt management plan in June 09 through CCCS, all but one creditor Capital One refused the monthly sums offered
Made a request to Lloyds Tsb for a 31.16 to see if they`d produce hubbies cca they wrote back sending up to date balance, cca and terms and conditions with my hubbies name added they could be anyones they state they cannot locate a signed agreement and will endeavour to look for it however they wouldn`t have given credit without having seen sight of this agreement account opened 2000 not responded to this reply as been told no such response really exists as it wasn`t a section 78 request even though Lloyds Tsb replied to it as one stating as such ignoring the fact that I highlighted that it was a 31.16

Hubbie as received various letters from MHA Collections and SCM Solicitors responed to each and every one stating they are fully aware what is available and nothing else is on offer it annoys me that they adress their letters "You have ignored several letters from our client" utter rubbish I reply to all letters and keep a copy and send everything recorded delivery I was just wondering should Lloyds Tsb have passed my hubbies account details to MHA or SCM without a letter of assignment?
If anyone does think their is something I could send or should send to Lloyds Tsb after they never sent a copy of a signed agreement could you please advise I am told that I could now withold payment to them as they are iin dispute? however to do this again has I understand it I`d have to cancel arrangements with CCCS to pay creditors as they refuse to stop paying creditors it`s all or none as far as they are concerned to be honest with you I`ve had all the hassle of letters/phone calls etc CCCS don`t do a great deal at all other than send the payments surely anyone could do this? I only went with them as I was advised that if creditors see that you are with a debt management plan they act favourably towards you I can tell you now that this hasn`t been the case I have had all the stress not them thought they`d take some of that off me looking after my hubbie is hard enough without all this

sadly these org's are actually funded by the banks and thus only have 'their' interests in mind. do it yourself...
as for the cca bit, there are recent threads concerning judgements about 'what' should be in a cca reply, these you can decide upon yourself, but the bottom line is really that even if its not enforceable, it doesn't make the debt go away, its not some magic bullet that writes debts off, contrary to what many reclaim co's proport.

Had a letter come stating for the sars it can be collected in branch if my hubbie wishes however they`d need a driving licence or passport to prove his identity, does anyone know if they then photo copy either of these so they have the signature? other than this their is a 4 page questionaire to fill in about the data request any advice please
Some more advice required please hubbie received Default notice dated 7th December when it came it had no post mark on would first day of service be the 14th December if we saying it was posted 2nd class? and 14 days from then is the 28th default states "Must pay us ***** by 29th December 2009" so is the default valid?
