    Default Ombudsman rejected my PPI claim

    Hi,
    I put in a claim against a company I have a secured loan with stating that the PPIicon was mis sold. I originally wrote to the company back in 2007 and didn't feel I knew enough of what I was doing when they wrote back saying that they didn't think that it was mis sold. At that point I left it after they told me on the phone that if I cancelled the insurance I wouldn't get the cashback option after 5 years which would work out at around £2k.

    Then I found this site and started reading up on everything. Feeling more confident I wrote to the company again mid 2009 this time including that I also felt it was mis sold due to the fact that I was not made fully aware of the single PPI (this is what I have with my loan). They wrote back and said that their view had not changed from when I wrote to them previously. I took this to the fosicon but they have just written back saying that as this wasn't put into them within 6 months from the original date being 2007 even though I had added additional points to it that they would not look at it.

    I have since spoken with the company again who now advise me that I feel behind with payments in 2006 and would not be eligable for the cash back option even though at the time of making my complaint to them in 2007 they told me that I was entitled to it. I now feel that they knew I wouldn't be entitled to it and just said that I was to stop my taking my complaint any further.

    Can anyone offer me any further advice on what step I should take next to try and reclaim some of my money back as now it looks like I won't get anything!!!!!

    Go back to the FOS they should look at complaints going back longer than six months. Talk to the FOS and see if there is a solution to this issue. I claimed back 12 + years. If you had previously complained to the FOS and not followed it up explain why and ask the for further consideration.

    If this does not get results then write to your MP explaining what has happened and ask you MP to intervene.

    I think that the problem lies because I complained to the company in 2007 and then again in 2009 and didn't take it to the fosicon until 2009.

    I will speak to them again but they were not willing to change their mind last time I spoke with them

    Make another complaint to the company giving them one final chance to resolve your complaint and ask them for their final response.

    They will probably write back stating what they already said but you will then have a final response dated within last 6 months.

    You can then issue a new complaint ot the fosicon who will definately look into it as it is within 6 months!

    When I wrote to them again in 2009 this is what I did but they worded the letter as to say that their opinion hadn't changed from the last time they wrote in 2007. They also made a point of noting in the letter that I could take it to the Ombudsmanicon but since it was after 6 months they weren't sure if they would look into it.

    The Ombudsman was happy to look into it if the company gave their permission which they didn't!!!!

    Any other suggestions?

    Hi,

    It all depends on whether the letter the company sent you in 2007 really was a 'final response' or not. Did it enclose a copy of the Ombudsmanicon Service leaflet, and tell you that you were entitled to take the matter to the Ombudsman providing that you did so within 6 months of the date of the letter? If so. then it was an official final response letter and unfortunately there really isn't anything you can do about it now.

    However, if the 2007 letter didn't include this information then it wasn't a 'final response' in the sense of the FSA regulations. In that case the Ombudsman Service wouldn't be entitled to refuse to consider your complaint simply because you first raised it over 6 months ago.
