    15/08/06 Statements Arrived with Microfische letter (account not very old so doesn't apply)
    16/08/06 Prelim sent for £264.37
    22/08/06 Goodwill Offer £96.00 - Declined
    31/08/06 lbaicon Going out Today unless they pay up
    28/09/06 N1 Deemed Served
    10/10/06 Defence Filed (we dont believe we have done anything wrong standard letter)

    Default Lost Paitence

    I have sent my Data Protection Act to Barclaycard , they have sent statments to May 2004 and say they cant provide anymore.

    I have worked out my charges from May 2004 to Today @ £672.00 , I worked out that I have been charged an average of £24.88 every month in charges and have estimated that between 24/08/01 to 24/04/04 @ 33x£24.88 and have added that to the spreadsheet as an ''estimated charge'' once a month and added the interesticon to that figure.

    The total is £1493.04 in charges and £816.17 in interest

    Basically my questions are

    1.) does this sound fair
    2.) it is ok to continue with prelim before the Data Protection Act's 40 days are up, bearing in mind thay have said they are unwilling to supply any more information.

    TBH Id wait until the 40days are up then do a lbaicon to that amount on the day the DPA expires. You dont want to get to court and find that the juge decides you havent abided by the rules and thus get struck out of court. Which CAN happen although of course it might not

    I did think about that but I have it in writing that Barclaysicon are not going to suply me with any more information

    I decided that I'd start with a prelim for the statements that were sent, whilst also pursuing the remainder of the DPA request separately, with a later action following if/when I get the required data.

    Barclaysicon managed to file the allocation questionare late and its has gone before a judge to see how it will procede

    That sound right to you ?


    Edit : I have a much bigger case again B/Card but cant afford to take it to court untill this one is settled.

    I never received my court bundle from them, so called them and they settled, but I'm very interested in BC getting a CCJ, thats so cool!...

    got the documents through from the court to say they have until the 1st febuary to pay , not a peep from Barclaysicon.

    I cant see the judge granting a set asideicon as they actually filed a defence , they just didnt turn up in court.
