    Default Court Interest Question

Hi There, I have only a few days before I am due to raise a court summons on RBSicon and I'm struggling to clarify whether the 8% is included in the £1500 max for summary cause in scotland or if it is added to the £1500. Any help would be appreciated.

    Thanks

There's a thread in the Scotland forum that covers this. According to whoever posted it (I've forgotten who it is), Judicial interesticon cannot be added to a claim until there has been a judgement by a court. Basically you would get interest for the period between a judgement and the bank paying you, and could not claim it from the date of charges as you can in England. However I'm not sure if this is just for small claims or if it also covers summary clauses. Have a look in that thread, it might help clarify things.
