In an attempt to pay more than the minimum payment on my card, I changed the direct debit. What then happened was my whole months salary was paid to Egg. The bank reversed this, but did not leave the card payment.
This also seems to have cancelled the direct debit altogether and I was defaulted. I have no other late/missed payments on my other two loans or two credit cards, and the default is now stopping me from getting a mortgage.
I have tried to discuss this with Egg, and having explained the circumstances to them, I had hoped they would remove the default as a gesture of goodwill as I am paying the defaulted sum off regularly.
My question is, does anyone have any experience of an Egg default from around this time, and is it likely to have followed appropriate procedures?
If not, could I force them to remove it via the legal system?
You have been a good customer, which works in your favour, but you need to get through to a high-up manager who can sanction a reversal on his own say-so, otherwise your file will take part in desk football.
Evidently automated IT systems serving 2 million cards have failed in providing personal attention, so now you need a human manager with enough clout to override rigid Egg systems and rules. Suggest you point out to Egg that you have no intention of welshing on your debt or requesting a CCA, which at this time will impress them no end. That would be the carrot.
For the big stick you make clear that you could do the converse. If they damage your credit rating and refuse to compromise you have nothing further to lose. You can also play hard ball. The worst party in all this was your bank, whose minions miscarried your instructions. Egg did not receive a payment on time, and presumably you did not respond to their DN in time (if they ever sent it), so technically Egg cannot be done for maladministration.
Thanks Mistermind. I spoke with Egg today and they are sending me a copy of their default notice, however it will have no dates etc on it. It will be useful to have a look at it though.
