I ordered a new VW Passat on 11th December. The order was placed with a main VW dealer after they found the car in stock sitting in a dock in Emden, Germany.
I was told that we should be good for delivery in December (at the 15% VAT rate) and the order was written out reflecting the Pricing based on 15% VAT.
I was aware that the VAT increases in January and if the car was delayed it would be subject to the higher rate of 17.5% VAT. But I repeat I was told we should be fine for Delivery in December and the order form reflects the pricing in December. I paid a £500 deposit and signed their order form.
The order form was marked by the dealer 'subject to December delivery'.
I was told on Christmas Eve that the car had not shipped yet (they couldn't tell me why) and it was looking tight for delivery in December.
Having visited the dealership twice in the last 3 days I am now told the car is still sitting in Emden which in their words is 'weird' and they are not sure why nothing has happened to the car yet.
I am making lots of noise about not being happy paying the higher VAT price in January but not sure exactly where I stand. The car is being bought on a PCP using Volkswagon finance - I have signed an order form but not the finance agreement at this stage.
Do I just have to accept I need to pay the higher VAT price when the car turns up in January (an additional £360) ?
I have told the dealer that they or VW should fund the increased price as I have been messed around. I really feel the dealer hasn;t made any effort to get the car sorted and delivered and now they are just shrugging their shoulders and saying I will have to pay the increased VAT in January.
Any advice on where I stand would be appreciated. Could I cancel my order and would my £500 deposit be refundable ? Any other advice appreciated.

You can tell them as they have failed to deliver in the time they stated that the deal is off and you want your deposit returned.
Failing that, you can ask for the next service to be done at their expense. You will actually dip in that way and you would be getting the better deal.

Thanks Conniff,
The dealer called last night and they are going to speak with VW to try and get a contribution from them due to to the delay in delivery.
I will bear in mind the free service although the first 30,000 miles servicing is included in the deal. On the whole I think I have got a decent deal so I am bit loathed to tell them to stick it ?
I will see what the response is from VW to making a contribution.

I meant to tell the to 'stick it' as you say was intended as a bluff to see what they say.
The customer will always get a better deal by asking for goods or services rather than a cash discount. That £200 cd player you have fitted free of charge will cost them only half that so they are more likely to go for that as you both dip in that way.
If it looks like the delivery time will be extended past your satisfaction, you can always set a date and make time of the essence of the contract. That's when you start to barter with them.
Remember that the scrappage scheme still running is only for £1,000 from the treasury, the other £1,000 comes from the dealer, so there is a thousand to play with.

Hi there,
As I see it, you should not have to pay the extra VAT. This should be sorted between the dealer and VW. As Connif says, you could cancel the order and ask for your deposit back. Personally, I reckon the dealer will not want to loose the sale so I think they will come across. However, I would make them aware that you would consider taking your business elsewhere if they dont.
