Barclaycard has just cleared out Bank Account today! URGENT HELP PLEASE?!?!
Hi all,
My ex partner was due to take our son Christmas shopping today but has checked his balance and £363 has been taken out of his account by Barclaycard, without his consent or knowledge.
He had defaulted on payments as has had very little work this year (self employed) and had to resort to signing on x3 months ago. It's taken JSA 12 weeks to sort his claim and so the money he has is the backdated Job Seekers.
He has been in touch with Barclaycard and Westcott during this time to advise them of his unemployed status and JSA taking their time, but made an arrangement over the telephone yesterday with Westcott to pay £10 a month.
Barclays bank have said that they can do nothing and he has just spoken with Barclaycard who said that they are within their rights to clear out every penny from his account and that they won't give it back..
Can anyone advise on this urgently please? At wits end with these crooks.

Hi BC,
This happens all too often. These people are scum and they use their right of 'set off' to divert the funds from your bank account to pay off card arrears. AND they'll probably do it again.
If your situation with BC is likely to continue then your ex must open a parachute account and have their funds paid elsewhere.
They did same too us - we argued - we appealed - and we still lost.
get out of Barclays is the only safe way of dealing with this.

They shouldn't ... but they do it anyway. And you won't get it back now.
Go and change bank accounts NOW and divert benefits there ASAP, in a non-affiliated bank, to stop it happening again. And never ever have your credit cards and bank accounts with the same provider.

thanks for your help everyone... I advised ex to call them again and say that they had no right to take his JSA as it's the minimum amount the Government says anyone should live on... luckily he spoke to a helpful girl who said that they would need proof that an agreement had been entered into with Westcot... he's been in touch with Westcot who should now be telephoning Barclaycard to confirm the £10 a month repayment plan. Will keep you updated... thanks again everyone...

Thanks for that. After taking my advice to let Barclaycard know that they'd dipped into his backdated JSA they agreed to refund just under half the money (£160), I'll have a read through this case later and let him know whether he can get the rest back.
In the meantime he's opening a post office basic account for his JSA to be paid into so that they can't just help themselves in future.
