Hi fellow CAGgers, Just sent CCA request to Barclaycard (was Skycard). I am hoping I can use the result (it's pre-2007) as a bargaining tool with regards a Full and final settlement. I have offered them a full and final of just over 10% so far.
I have a Barclays account so I want to play safe here.
Will wait and see what comes back..... I for one can't wait!!!

I have indeed, they seem nearly as bad as MBNA! I suppose the problem lies in them admitting they have no enforceability. I can't bargain with them if that's the case... although I can only try!!! lol.

Hi BB, I moved the above post from the BC Stickies which should not be posted on unless adding usefully to their content.
Don't worry about the address you used for the CCA request. It's only critical to use their correct trading name and London HQ address when filing court action against BC.
I normally suggest using the statement address while others say use the Co Registered Office.
You'll get a reply but maybe a few days late. Given it's the silly season, there may be delays anyway.

I have now made another Full and final settlement offer of 20% of the balance on the card. They never replied to my first letter offering 10%. I think 20% is more realistic.
I hold a current account with Barclays and was wondering if they would look into how much was in my account!!! I have deposited a cheque for £10k from a family inheritance. Is it possible they could see this amount and demand the full amount? I have a dmp with them and the card inactive and have kept up with the payments.

From reading previous post BB I have noticed that they will freeze your bank account and take payment from it. Don't know how quickly they act regarding this but I am in a similar situation re Skycard and holding a joint Barclays account and have been advised to move money elsewhere. I CCA'd them in November nothing sent to me yet and so far no payments taken from my acount as yet. Keep meaning to go to branch and remove my name from joint account.

If your BC a/c is delinquent and you pay this £10K into the Barclays current a/c, they WILL take whatever is o/s on the BC a/c using their well-established and well-used Right to Set-Off.
If you don't want them to help themselves, use the cheque to open a non-Barclays a/c.
Or pay BC what you owe them and start to clean up your credit record.

What do you mean by "delinquent"? They accepted my dmp and I have kept to the payments. The account is not in default. If this was the case, how come they don't take money from my account when my salary goes in?

I can almost guarantee they will take the money from your current account.
Dont trust Barclays at all !
Going on my experiences i would advise you to change your current account as soon as possible.

Delinquent = a/c being in arrears or outside their terms of use.
If you are paying through a dmp and keeping to the arrangement, that's why they don't take money from the c/a at the moment.
But if they see a hefty credit go into your bank a/c, BC and Barclays will have been in touch with each other and there is a risk of a Set-Off.
You may be quite right, that the a/c has not been Defaulted but, if you are in a dmp, I assume you've had trouble keeping to the payments which would have been normally due on the a/c.
My point is this - if BC nab your money, you will not see it again. You can argue with them till the cows come home, but they'll have your money and close the a/c if they get a chance.

Yes mine used to be Skycard too, now become Barclaycard. I delibrately didn't CCA them because of my current account with them (as advised on CAG) but I never realised they would do this. It is encouraging that they have not taken your money straight away! Thanks for posting. I will try to get another account asap and move my money, however, I know I can't go to Natwest and RBS due to me claiming bank charges and had an unpaid overdraft facility prior to my dmp (paid off with bank charge refund) and I was declined an account by Natwest a few years back... I believe it to be connected to RBS now. I think I will just have to go to the bank when the cheque is cleared and take out as much as I can. Is there a limit to what you can take out over the counter?

I am pretty sure that you would not be turned down from opening a savings account with another bank. You can then put the money that you do not want Barclays to touch in there.
I used to go and draw out all my wages on pay day so that Barclays could not touch them but unfortunately , due to work commitments , i was not quick enough with my end of december pay and that is when Barclaycard pounced and took over Half of my monthly pay !!

How Annoying - I posted earlier but must've mucked up somehow. I think I said .........
Well, if it's been paid in already, we'll just have to see what happens. Worst case scenario is they nab it, and that's an end to the BC debt.
Are there any penalty charges on the a/c which you should reclaim.
If you want, go into your branch when the cheque's cleared and withdraw the amount in cash. Then use that to open an a/c elsewhere. I believe the A&L (now Santander) may be useful.
