    Question Any ideas?

    Hi all,

    I have a CC with Eggicon which I first got some years ago (can't remember exactly how many although I think probly 6 or more). It had a limit of £2000, which I went over and they ended up increasing it to £4000 because of all the charges etc. I then cleared all at once (by getting a loan) and they immediately put my credit limit up to £8000. I should have cut the card up there and then, but I never. I had kids and it soon all mounted up. Anyway we got into a lot of difficulty and they defaulted us and the debt is now being dealt with by their solicitors I believe.

    From reading some other threads in one of the other forums on this site I'm looking at the CCA request.

    Would I be better off firstly sending the CCA request to see if they have an original copy of my agreement? If they don't then I can request all payments made to them to be returned and any defaults removed as the debt is unenforceable. If they do, then to send off the S.A.R - (Subject access requesticon) and claim back any charges. I no longer have any statements from them at all, I'm not even sure if I have my account number. Although I'm assuming it *may* be the reference number which their solicitors use? In which case I should have it somewhere.

    Any ideas? Would this be the best route to take?

    EDIT: to add, It was in my maiden name and have since got married, what difference would that make? Also what address would you send the CCA request to? Waterhouse Square, London? Or one that I've found on a letter from them - Recoveries Team, Waterfront West, Brierly Hill?

    I would say the S.A.R. This is important if you don't have any information, to get this sent off a.s.a.p. Don't forget to send it recorded delivery. You could always request a copy of the original agreement also, if you are in doubt that they can produce it.

    You can request all data they hold on you thats held in a relveant filing system.

    So if they have electronic copies of your applications forms then you shiold get this straight away when you make your SARicon application.

    I would also consider writing to their solicitors disputing the amount owed on the basis of the fact that Eggicon may have added unlawful charges.

    In this way you will prevent them progressing the debt further since the amount you owe is being disputed and until the dispute is resoleved they cannot pursue the debt.
