Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Well, ill try and keep this short and sweet otherwise ill be here for hours.
Back in 2007, it came to my attention that i had direct debits set up on my account when i went in to make a relativly large withdrawal, to be told that i would actually be over my arranged overdraft limit if the transaction was to be authorised.
Firstly, i asked what overdraft, as i wasnt aware that i had one, and secondly was where had all my money gone. I had 2x Current accounts with the Abbey that were being used as savings accounts for surplus income from other projects that i was working on at the time.
Anyway, after nearly passing out, i found out that in total over £23,000 from both accounts had been drained by DD's,and transactions, that belonged to somebody else, not me. I was unaware that i had even been issued with a debit card as i just asked for a noraml account to deposit money in, and this is what i was issued with.
As the DD's, had been taken over 2 years, i was told that this would have to be investigated by the banks fraud team before this matter could be progressed. They did this and then closed accounts and passed the matter on.
What they did make me do though before hand was to go through bank statments, highlighting DD's that i did not believe to be mine (all of them). I had to do this on a number of occasions over several months before this matter was sent accross to the DD Indemnity team.
The woman there seemed very helpfull and said that she would get to work refundidng my money. This took about 3 weeks, but only £15,000 has been returned so far, over the course of 4months
Unfortunatly, during this time i became ill making it a very low priority to get this money back, but now i am in good health, im finding it very difficult to get anything out of them. They are taking months to send me statements, then they want me to higlight and cross ref DD's that have been returned already, so they know what DD's they need to look at refunding still. SURELY THIS ISNT MY JOB.
Also, i have been reading up on this and the bank should have refunded all these monies as standars straight away, as soon as i reported this but years down the line i am still waiting.
Is there a letter that i can send them or anything that i can do to boot them up the a** to get me my money back before christmas...!? Am not in the financial position i used to be in due to ill health and could really do with this money asap!
i dont doubt what you are saying is true but i have to ask, if the dd's went out over 2 years and you say you never placed any dd instructions out of this/these accs, then am i right in thinking that you couldnt have checked the acc's for that whole period, i find that some what strange and if i am right i would think that the Abbey also find this a strange thing that you never checked your acc's. also if you did why did you not pick up on the wayward dd's sooner. i think this is why they are making you jump through hoops, i think they dont believe you and are looking for you to slip up, this happened to a mate and they sorted it out within 3 months, that was for a 4 figure amount, his was due to a hijacked account with a few several largish purchases not through dd.
Sorry, i dont know if i made myself clear enough or not. I missed bits out.
The account was set up purely to save money, a savings acc if you will.
However, the account was completely minipulated and the address had been changed, internet banking set up, replacement cards ordered etc etc. So no, i never recieved anything in relation to this account.
As for the 2 years, i have been complaining for over 2 years that i still have no resolve, not that i have just decided to complaing after 2 years.
I have today recieved all my statements in relation to this account and a covering letter apologising, saying that "we thought your complaint had been dealt with in full and therefor, case closed".
But they have advised me that I can now re-instate the case and get this looked at.
POSTGGJ;
Ive heared about this through my MP, but does it mean that they have to refund the money straight away but you dont have the right to withdraw funds until the claim has been fully concluded..!?!?!
