Landy v C&G mortgage charges ***WON***
Hi everyone
It's a bit late to be starting a thread on this as I've already received notification that Cheltenham & Gloucester intend to uphold my complaint, but as it's a success story I thought I should do so anyway!
Mr Landy and I had a mortgage with C&G which we repaid in full when we sold our previous property in 2007. We had experienced some financial problems at one stage during the three years we had the mortgage and had run up a couple of hundred pounds worth of late payment charges.
In August this year I wrote C&G a letter requesting a refund of those charges and initially received a 'we don't believe our charges are unfair' type response, although C&G said that if we weren't happy with this answer I should contact them again and they would do their best to reach an agreement with me.
I duly wrote again and have just heard that despite their insistance that the charges were fully justified, they are prepared to offer the full amount claimed, which included contractual interest plus a further 8% simple interest, totalling about £450
As C&G are part of ltsb who are notoriously hard to beat, I am unsurprisingly very pleased with this result - it may only be small, but it's the principle of the matter!
At this stage I have only just returned the acceptance form, but once the cheque is received and it has cleared I will post up again and this thread title can be changed to 'won'

Cheque from C&G received today and paid into bank
It just goes to show how in some cases you can get these mortgage charges refunded without too much hassle. In this case it took 4 letters and 4 months from preliminary request to receiving the cheque.
Hopefully this will give inspiration and encouragement to other Caggers!

I am new to this and have been reading about mortgage exit fees also with C&G I have 2 old statements that also show the charges but I don't have my account closure statement that I payed off 3years ago.
I have read that you can get the exit fee refunded if it is a (MEAR) or similar. I have a charge of £225.00 listed as (Aclosing administration charge) would you know if this is one in the same or not. Also is it the same process for reclaiming missed payment charges for a mortgage as it is a bank account.

I'm not sure to be honest whether the closing admin charge is the same as a MEAR. We also had one of those but didn't reclaim it, so I can't be much help there I'm afraid.
The method of reclaiming the other charges (late fees/missed payments etc) was exactly the same as that used for bank charges - I just adapted a template letter accordingly, added a spreadsheet showing the charges plus interest and sent it off recorded delivery to C&G.

Hi folks
As a footnote to this story which indicates how c**p the postal service is, I today recieved a letter dated 4th January 2010 from the person who was investigating my C&G complaint stating that I should be receiving my refund cheque with 5 - 7 working days. The postmark on the envelope was dated 4th January 2010 and there were no signs that the letter had been redirected from elsewhere...........this is the cheque I received on 7th January
