Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
CCA requested 23/11/09 SAR same date.
Looking through my paperwork again as follows:-
31.01.2008 "We are ending your Egg card agreement" letter.
07 Aug. 08 Default Notice
08 Aug. 08 Capital Collection Agencies letter
18 Aug 08 Default Notice
16 Sept. 08 "Egg Card account terminated " letter
04 Nov. 08 "unable to contact you" letter
I'm sure read somewhere that you can only be defaulted once for a debt and I've got 2 DN's, is this right?
Can't see anything wrong with the DN so no idea why they sent again. The fact that they did doesn't help much as i'm sure the 1st would take priority and it appears to be OK to me with regards to dates.
Someone else maybe able to comment on prominence of wording etc but i'd be inclined not to use that as a defence unless it was part of a bigger picture i.e. I think you'd be hard pushed to find a judge that would accept that alone as a valid argument.
Thanks M, I'm not even thinking about defence at this stage. Been reading through your thread today re Egg - yikes!
I've got 2 egg's on the go at the moment both CCA'd at the same time and 12+2 days is today so time for me to start thinking about sending the dispute letters out.

Hi N,
Well if you've seen the Egg Loan one you'd have seen the importance of the DN! Plonkers lol.
I'd send the dispute letters. Egg are well known for taking an age to reply - then the reply has no relevance to the points raised.
I know from others that generally they are pretty good with DNs and the like, but from experience of mine it's always worth a look.
Yes, I looked at your DN - amazing!
I've also SAR'd because (although I'm embarrassed to admit it) I have absolutely no idea how long ago I got these credit cards, I very rarely looked at the online statements and I honestly don't even know how much I owe them at the moment.

It's not that embarrassing. With the speed and amount of times that balances were transferred, card companies taking each other over etc etc it was easily done. I've been quite surprised myself at how old some of my cards are when the original CCA turns up
Update
received cca for this card today, looks the same as others posted here.
Dated 2001 so at leaast I know how long I've had it *grin*
Interstingly it has a card number hand written on the top which doesn't mean anything to me, it's not my card number! I'm still waiting on the SAR, Egg acknowledged my request for this and said they will send by 3rd Jan. so think I will sit back and wait for it to arrive.

Hi nunny,
2001, same as mine (and I was a year out too ).
The SAR is HUGE with EGG, mine came in a box!!! Lots of interesting bits though. Can't remember - was there PPI with this?
never requested PPI but it was added at some later date - I only realised that ppi was being added when on 1 rare occasion I looked at statement online and saw it. I complained, they stopped it and then they reinstated it again at a later stage. They did this with both my cards, this is why I'm waiting for the SAR before I do anything more.
I logged into my accounts last week, haven't done this for over a year so was quite excited about having the guts to do it Statements only went up to september 2008 so I have absolutely no idea how they have been applying the payments since then. AND then the day after I logged on I received an email from Egg "Helpful information from moneymadeclear"
