Not been on for a while between the snow and family illness.

Update:

Got a letter from them saying the PPI was taken out over the phone 1 month after the application.

We asked them to supply proof of the call etc, they replied with below.

Put in the claim early November.

Have had the defence back from Capitol one. What a load of rubbish.

They are still going on about him taking the ppi over the phone when he activated his card, although they have still not proved this.

Answered the allocation questionnaire. and have put in an order for directions about the so called call.

Will update as we receive.

Activation of card is by auto dialler no human contact?

Hi Mike.

That is what I thought, I have never spoken to anyone to activate my cards. Morover are they saying that the person he spoke to to activate his card just happens to be someone that was qualified to sell PPI.

Well we will wait and see if they can produce this activation call.

Am putting up parts of the so called defence.

The strange thing about all this is that he has in fact 2 agreements from them 1 is dated July and the other is dated August. My son does not remember why he had another one sent and the only thing i can see is that the post codes are different so I am thinking that they sent him a new agreement with the right post code.

If there is anything else here that looks dodgy would appreciate any comments.

Hi Everyone.

Well as you will probably know we lost a BC case recently on Statute barred defence ( claim was struck out).

I thought I had better check the details on this case and thankfully it would appear they will not be using that route as it was well within the statute time.

Still not had anything back on the Order for Directions either from them or the court.

Will update as soon as we get any thing.

Still nothing from the court, will ring them tomorrow and see if they can give me some idea what is going on.

Spoke to the court and they say that Capone have sent in their AQ, will see what comes back from the court.

HI EVERYONE SORRY FORGOT TO POST BACK IN 2009 CAPONE PAYED OUT AND OFFSET IT AGAINST WHAT HE OWED WHICH LEFT HIM WITH ABOUT £70 TO PAY HAVENT COME BACK FOR IT
