    Default Barclaycard Agreement

Should be grateful for advice on this Barclaycard agreement from Oct 1983
Is this enforceable ? The T&C's supplied one from 1983 and present, both refer to pin numbers, so obviously Barclaycard have not supplied 1983 T&C

On the copy agreement supplied it's dated with both my signatureicon and Barclaycards.

    Any advice would be appreciated.

Looks like a blank form. If so, it is completely useless. If there is a copy with your signatureicon on it, then it would be enforceable since it has all teh prescribed terms

Thanks for your reply. Yes the copy agreement supplied (same as blank copy) has my signature on ! So would appear my Barclaycard agreement from 1983 is enforceable

    Hi Brown,

It would be more useful if you posted a copy of the doc't that bears your signatureicon, but hide the sig're and any other personal dataicon before posting.

In your first post, you say the supposed original signed doc't refers to PIN No's.

Yes I was thinking the same.
I think Brown was referring to this being something that was absent from 1983 agreements ?

In the final analsis (s127(3) of the CCA 1974), all a credit card agreement needs to be enforeable is a signatureicon, a term giving the credit limit, a term giving the interesticon rate and repayment terms. Everything else is irrelevant.

Is there any reference numbers on the lower portion of the agreements they have sent ?
Barclaysicon docs usually incorporate the dates with other numbers on their forms.

The original application goes back to 1983 and is it enforceable ? T & C's supplied are not from 1983 ! Comments would be appreciated.

    Hi Brown,

Regardless of Pin No's in T&C's, etc, the doc't in the 2nd Photobucket link above is an enforceable credit agreement.

Out of interesticon, can you confirm what method you used to get sight of these documents.

Thanks for your comments. Looks like Barclaycard had their 'act together' in 1983 ! Obtained the documents last year following the usual letter request. I wonder how Barclaycard can provide an enforceable agreement from over 25 years ago yet they have problems with more recent agreements ?
