    Question Taperjeangirl -v- Barclaycard, Visa a/c

    Hi, pls can anyone help me with my case! I sent a SARicon and £10 cheque to Barclaycard for a default Visa account from a few years ago, and also the Morgan Stanley Mastercard I had which they took over.

    They replied by firstly sending me a copy of the terms and conditionsicon then a copy of the credit agreement (not the original I signed) and only for my current card, not the old one.

    I know I have over £2000.00 worth of charges in particular on my old visa card, so am keen to get my statements and make a claim.

    Can anyone help me with what letter to send back to them as I have tried to find the correct one on here but am really confused!!! Thanks!

    If they have not complied with your SARicon then you need to firstly warn them of the consequences..

    There are template letters in the bank templates section HERE for non compliance with subject access requests(letter 18), send one of these off first and then if nothing you'll need to either take them to court for non-disclosure or complain to the ICO (can take around 6 months to investigate )

    Hi TPG,

    Follow The Shadows advice above.

    Please use this thread ONLY for the BC Visa a/c - I'll re-title it for you.

    Then start another thread for the MS Mastercard when you have something to report on that one.

    This will keep details for the 2 a/c's separate.

    When you write back to BC, give them the a/c nos. of each a/c to help them find the right data for each.

    Hi, after a sending another letter to Barclaycard I have received my statements etc for my current morgan stanley mastercard but they have sent me no info on my old visa card (they have suspended my mastercard "due to the position of my other account").

    They have not provided any info for my old account which I am keen to claim back charges of over £2000.00. They have not even acknowledged this account at all yet they have debt collectorsicon chasing me for money.

    They have also not provided a signed CCA just the terms and conditionsicon.

    Pls help me with where I stand and what to do now!

    Hi TJG,

    If you've already sent BC the lbaicon re SARicon non-compliance, your next step is to file a court claim against BC seeking an order that they produce the data as required.

    Read up on this in Articles 18,19 & 20 in the Bank Teplates Library.
