My husband bought a van from a used van/car salesman 4 days ago which kept jumping out of first gear and stopped working on the first day, it had to be pushed into a side road where it has sat ever since. The dealer didn't let my husband test drive the van (as he was not insured) but drove it with my husband as a passenger. My husband was told that it needed a service and minor faults were raised, which were obvious to see. We have been trying to get the seller to agree to take a look at it. Finally today, my husband towed the van to the dealer (with his help) as the engine wasn't starting and the dealer agreed to repair it. He said that he will give my husband 2 days to drive around in it and then we can't take it back if it breaks down again.
I spoke to consumer direct and they gave me some vague advice as it was not bought buy a business but with the intention of starting a business. They also told me that we should accept it if the dealer offered to repair the problems.
We are not sure what our rights would be if the van broke down again after repairs, taking into account wear and tear and the age of the van. Please advise.
