    Hi Appo,

This is the usual scenario really......

CCA request, T&C's are the response, you put a/c in dispute and they say they've fulfilled their obligations imposed by CCA1974.

Read this short thread which ends with a suggested template for use in complaining to the fosicon - http://www.consumeractiongroup.co.uk...rclaycard.html

Are there any penalty charges or mis-sold PPIicon on the a/c which you could reclaim.

    Sorry Appo,

I forgot to include the link in my last post - I've put it in above now.

If you don't have the a/c data, send off a SARicon.

    Update:
Letter send to fosicon. (no reply as yet)
Account in despute sent to merces
Been bombarded with phone callsicon from merces, including one on new years day. harassment letter sent , Calls have stopped.
Received a letter today from Barclaycard.

"I write to your recent letter alleging that we have failed to comply with our obligations in relation to your request for documents pursuant to section 79 of the Consumer Credit Act.

Please note that we have already set out, in detail, why we are satisfied that the documents already provided to you have discharged out obligations under the Act. We are under no legal obligation to provide any further documentation to you in this regard."

Do I leave it at that and wait for FOS to contact me?

    Hi Appo,

Wait for contact from the fosicon and then decide how to proceed.

There was a recent Judgement handed down by Judge Waksman in a set of cases heard at the Manchester Mercantile Court. There's a thread discussing the cases here but, be warned, it's a fast flowing thread - http://www.consumeractiongroup.co.uk...-new-post.html

I wonder if, following the ruling on 24th December, BC have decided to dig their heels in, even when the FOS get involved.

    Please keep us updated.
