    Default RBS Loanguard v Questioner

    I am thinking of reclaiming for a RBSicon Loanguard policy.

    I have found the agreement too.

    We only just found out that PPIicon was attached and were self - employed at the time.

    If needs be I can upload the while policy so that others can check it with benefit to themselves. We tend to save everything so.....

    This is the agreement the PPI is attached too. Although this loan has now ended the enforcibility of this doc may have been questionable too. S 18 springs to mind re Multiple Loans banged up as one for starters.

    This however is not the main resaon for this thread. I just want to use it to record how we go on with the prospective PPI claim..

Nothing seems to have happened since they came into power as a coalition. PPI Insurance has been sorted. Now they should turn their attention to bank charges and help customers get exorbitant charges refunded.

    There are no dates at all on the agreement - will have to check on the statements.

    We know its finished though as the amounts due stopped on statements and the bank confirmed it was done with a while back.

    our records indicate that this loan started in April 04.

    The bottom right hand corner is interesting

    They have bunged the main loan and PPIicon all together.

    The APR box is 15.9 %

    Is all this correct? SOMETHING FEELS WRONG TO ME.

    As I am new to this PPIicon thing I would appreciate it if someone could show me the best shortie letter to start the ball rolling against this Loanguard issue.

    Perhaps just a short please give me the dosh back type letter, that the bank can refuse to comply with, so that I can subsequently bang in a more detailed one after that...

    I do have one in the wings from another thread but will save this until later on.

    Basically - I was self-employed and had business insurance at the time; did not know what the heck PPI was and would not have wanted it. It seems like it was just shoved onto this contract above .

    I got this off RBSicon




    These are the reasons it was missold


    I was self employed at the time and they were fully aware of this. I had my own business insurance (being self-employed) therefore PPIicon would never have been appropriate to me. Moreover, I believe that on the basis that I had business insurance any prospective claim in the PPI field may potentially have never been accepted by the PPI seller.

    I was never given any appropriate professional, unbiased advice or choice over this product by them. I had no idea what PPI actually even was, what it entailed and the huge monetary costs to me associated with its addition to any policy.
    I was given the overall and grossly confusing impression that PPI was an indispensable component that one had to accept without question. This I believe to be unfair and extremely misleading. I was not ever informed that I could obtain cheaper alternative PPI elsewhere, if required either. I told them that I noted that this latter concern has now been the subject of an enquiry by the Competition Commissioners Office who were especially critical of PPI.

    I have serious doubts that I ever even said yes to any PPI product, believing that any tick box or whatever used on any application form may have been ticked already, before I saw this. In fact this belief is supported by the fact that the unsigned Personal Application Form, relating to this account, has been filled in by THEM – not me.

    I also mentioned ...............

    fosicon statistics for Jan-June 09 illustrate that a huge 94% of insurance complaints against RBS were upheld.

    They may not like that bit too much.

    Any bank-crushing PPI tips always appreciated folks.......

    Very long thread but useful stuff in there and letters which may help you out.

    Give them their 8 weeks as required by law and then bang in a complaint to the Financial Ombudsman Service.

    Please ensure you have copies of all correspondence both ways to send with your complaint.

    The complaint to the fosicon will result in a charge of £500 being levied against RBS by the FOS.

    how much is the case fee?
    The standard case fee (which we charge for the fourth and any subsequent “chargeable” case during the year) is currently £500 (from April 2009). Case fee arrangements are reviewed each year and may be subject to change.
    Believe me RBS will be well over 4 cases. :grin:

    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Alan - lovely thanks a lot.

    I will study it in detail as soon as I have attended to more pressing shark attacks on other threads, which have rolled in today.

    The PPIicon thing is proactive and great but I have to watch my defensive back too.

    I have been successful on 3 RBSicon loans in the last wee while. 2 of them took @ 12 weeks and they sent letters as per above. Sometimes the delay is caused by the local branch being slow to send out the info - esp if the loans are old.

    Keep on top of them. RBSicon will try everything to keep you off track while they spend thousands of pounds in sponsorship keeping formula 1 cars on track

    Claim went in at end of November and they have just written again asking for my patience whilst they investigate.

    This time however they did say I could go to fosicon if I was unhappy about the wait.

    How sweet of them.


    Not sure what path to take .
