I am thinking of reclaiming for a RBS Loanguard policy.
I have found the agreement too.
We only just found out that PPI was attached and were self - employed at the time.
If needs be I can upload the while policy so that others can check it with benefit to themselves. We tend to save everything so.....
This is the agreement the PPI is attached too. Although this loan has now ended the enforcibility of this doc may have been questionable too. S 18 springs to mind re Multiple Loans banged up as one for starters.
This however is not the main resaon for this thread. I just want to use it to record how we go on with the prospective PPI claim..

As I am new to this PPI thing I would appreciate it if someone could show me the best shortie letter to start the ball rolling against this Loanguard issue.
Perhaps just a short please give me the dosh back type letter, that the bank can refuse to comply with, so that I can subsequently bang in a more detailed one after that...
I do have one in the wings from another thread but will save this until later on.
Basically - I was self-employed and had business insurance at the time; did not know what the heck PPI was and would not have wanted it. It seems like it was just shoved onto this contract above .
I was self employed at the time and they were fully aware of this. I had my own business insurance (being self-employed) therefore PPI would never have been appropriate to me. Moreover, I believe that on the basis that I had business insurance any prospective claim in the PPI field may potentially have never been accepted by the PPI seller.
I was never given any appropriate professional, unbiased advice or choice over this product by them. I had no idea what PPI actually even was, what it entailed and the huge monetary costs to me associated with its addition to any policy.I was given the overall and grossly confusing impression that PPI was an indispensable component that one had to accept without question. This I believe to be unfair and extremely misleading. I was not ever informed that I could obtain cheaper alternative PPI elsewhere, if required either. I told them that I noted that this latter concern has now been the subject of an enquiry by the Competition Commissioners Office who were especially critical of PPI.
I have serious doubts that I ever even said yes to any PPI product, believing that any tick box or whatever used on any application form may have been ticked already, before I saw this. In fact this belief is supported by the fact that the unsigned Personal Application Form, relating to this account, has been filled in by THEM – not me.

fos statistics for Jan-June 09 illustrate that a huge 94% of insurance complaints against RBS were upheld.
They may not like that bit too much.
Any bank-crushing PPI tips always appreciated folks.......
how much is the case fee?
The standard case fee (which we charge for the fourth and any subsequent “chargeable” case during the year) is currently £500 (from April 2009). Case fee arrangements are reviewed each year and may be subject to change.
Believe me RBS will be well over 4 cases. :grin:

Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

I have been successful on 3 RBS loans in the last wee while. 2 of them took @ 12 weeks and they sent letters as per above. Sometimes the delay is caused by the local branch being slow to send out the info - esp if the loans are old.
Try and keep the timescales tight. I allowed them too much time and so my claim took nearly 12 months. 8 months of fighting RBS and 4 months for the fos to uphold my claim plus ICO slapped RBS for not knowing Direct Line Financial Services had been legally transferred to RBS and so should have automatically dealt with the entirity of my complaint.
I no longer get monthly calls from my friendly customer support to see if they can help me with my finances.

Thanks folks - I shall not give them an inch as that is not my way.
May need to send a gee up response soon as my claim went in at the end of Nov.
Keep on top of them. RBS will try everything to keep you off track while they spend thousands of pounds in sponsorship keeping formula 1 cars on track
