    Default Halifax PPI claim

    I emigrated in February and want to claim back my PPIicon with Halifaxicon as I believe it was missold.

    However I've just received a letter stating that PPI no longer covers me as I'm not a UK resident. They are offering me a refund of premiums backdated to Feb 2009 when I left the UK as long as I apply within 30 days (it's taken 2 weeks to get to me with the postal strikes). Will accepting this refund affect my chances of reclaiming the full amount if it goes to fosicon? I've attached the image to this post.

    Difficult to answer as the thumbnail is not readable and stays as a thumbnail when clicked.

    You should if deciding to accept a payment state that the payment is only accepted as a part payment pending a Full and finalicon settlement of your claim for mis-sold PPI and that you will pursue the settlement in full via the FOS and/or the Courts should the claim for mis-selling not be met in full and final settlement by Halifax.

    PS IMO you should not just claim back to february but to the date your PPI with halifax started. You should however have a valid reason to claim mis-sold PPI. Please read the stickies at the top of the forum for further information.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Without knowing the detail of the terms and conditionsicon it would be wrong of me to try to support you with a 100% satisfactory answer. However I will state this.

    When it comes to PPIicon reclaiming the banks or whoever will use whatever they can to put a consumer in following up their claim.

    If you consider you have been mis-sold PPI and have a valid claim on the premiums you paid plus the statutory interesticon then keep at them.

    If the PPI is still attached to the Halifaxicon loan/card etc then you should cancel it but ensure you still have cover if you owe money on the loan/card.

    If you have been offered the refund of the premiums as you indicate then you should also IMO claim the statutory interest at 8% on the premiums from the date the premium was paid up until the claim is settled.

    The full amount you could reclaim that the FOS would uphold would most likely be the premiums you had paid plus the 8% statutory interest.
