Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I apologise in advance if this is in the wrong place, i did check out some of the Forum rules and i think this is ok, so here goes...
Please bear in mind, that when it comes to this kind of thing, i really am as thick as sh*t.
I have a debt of around 14k on my MBNA credit card. There are no particular problems with paying it off at the mo, apart from the obvious fact it's a hell of a lot of money/interest. I received a call today from The Claims People, who are apparently part of the FSA (i have called FSA and they confirmed they're a legit company). The guy said something along the lines of if MBNA have raised my credit limit without me signing for it (which they have done several times), and i have had my card since pre 2007, then i am entitled to compensation (card debt wiped out?).
There is a fee of £495 which apparently is fully refundable if they lose the case. They said they only take on cases they know they have a 100% chance of winning and have never failed.
I'm imagining there will be more than a few people reading this laughing their heads off. Can someone tell me if this is really possible? Will there be a downside like my credit rating will be buggered forever? If it complete bull, how are they allowed to do this, being linked with the FSA and Ministry of Justice etc? What's the catch?
Sorry if this post is really basic. I have no idea about this kind of thing and it obviously sounds too good to be true. I was going to put this in the MBNA thread, but it was more to do with the Claims People than MBNA themselves. So, is this possible or should i say 'ta, but no ta' straight away? Thanks in advance...
I received a call today from The Claims People, who are apparently part of the FSA (i have called FSA and they confirmed they're a legit company). 1st lie, they are not part of the FSA
The guy said something along the lines of if MBNA have raised my credit limit without me signing for it (which they have done several times), and i have had my card since pre 2007, then i am entitled to compensation (card debt wiped out?). 2nd lie, possibly but not a foregone conclusion
There is a fee of £495 which apparently is fully refundable if they lose the case. 3rd lie, not what their T&C's say
They said they only take on cases they know they have a 100% chance of winning and have never failed. 4th lie, they only know if they have a good chance of success after you have paid the 'evaluation' fee, which is non-refundable
. Can someone tell me if this is really possible? It is, but you can do it yourself at no cost
Will there be a downside like my credit rating will be buggered forever?
For 6 years maximum, but I would imagine with 14k debt it's already buggered
If it complete bull, how are they allowed to do this, being linked with the FSA and Ministry of Justice etc? I can't see their MoJ CMC no. on the website and they are not registered under that name at the MOJ
I have no idea about this kind of thing and it obviously sounds too good to be true.Quite right
Thanks for the reply. Not had access to the computer for a few days.
I didn't go ahead with it, you and a few others i spoke with all said ' Noooo'. One thing though, even though i've never made a late payment, will the fact i have 14k on my card go against me when trying to get future loans, bearing in mind i usually pay the minimum payments each month.
