Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
My son bught a car from FordXXXXX and he financed it through Santander. We have a dispute with Ford because the car was missing air conditioning etc. When reading the contract I noticed it is a Fixed Sum Loan agreement under the Consumer Credit Act 1974 and is not HP. When I asked for a CCA for the car I used section S79 for HP instead of S77 for Fixed sum loans, I wonder if this invalidates my request for a CCA?
Should I write in and correct that sentence or start all over again?
Re: Used S79 instead of S77 in my CCA to Santander

Re: Used S79 instead of S77 in my CCA to Santander
The contract was signed on the 2nd Septemebr 2007. We have a string of letters and telephome conversations but could not get an offer in writing from Ford xxxxxxx, Santander don't reply to my letters other than to say they are examining my complaint. Ford xxx offered to exchange the car and give a refund of £400 but refused to put in writing.
SANTANDER HAVE IGNORED THE CCA AND THAT IS UP. and Ford xxxxx have ignored my SAR and that is up.
I have been reading lots of letter about Unfair trading regs, but what use are they if one cannot go to court and claim damages for breach of contract and ask for the contract to be declared uneforcable?
