    Default Co-op Im confused?

    Hi, some help please

    I posted some time ago that the co-op sent me a letter in July stating that they couldnt find my signed copy as " it is no longe on file "

    I have just recieved the last part of my SARicon and they now have a copy of the signed agreement.

    I am looking at this and am perplexed as to the bottom of the page were it looks like someone has given this applicaion a card number as part of the Number is per-prined and then the rest has been added so I would think that this is the account number allocated.

    When I look at the card number that was printed on the card and statements this is not the same number??

    On the so called copy statements the card nmber also changes in 2005 the last 8 digits are completely different but no record of a new card being sent in the SARicon.

    They are now asking for a income and expenditure to try to agree a repayment and have also offerd me a 50% settlement ?? is this a caeof BBB???

    I am hoping tp ost a copy of the agreement ASAP for your comments.
    any assistance or advice would be most greatful.

    No wonder they are offering you a 50% settlement - this is purely an application form and totally unenforceable - it has none of the prescribed terms required of a credit agreement - credit limit, interesticon rate and repayment schedule. Send them the Account in Dispute letter and don't pay them another penny until they send you a copy of the agreement - Hell will freeze over first as they don't have one. This is typical of the toilet paper they sent out at that time.

    I have not posted on this matter for some time as things went quiet.
    I have had three phone text from Fredrickson and two letters to date.

    I have not contacted them or sent any letters as yet as I wondering how to handle this.

    If you look at the application form it has some stuff about being a credit agreement in the top left and also states a APR on the top right.

    so can someone please advise on if they think this is enforcable...

    I also have a termination Notice in My SARicon so can you please confirm if an account has been terminated if they can add interesticon and charges

    The APR given is an example only - it has to be embodied in the text of an agreement to be an prescribed term. It may say something about an agreement but there are no prescibed terms so it is not an agreement but an application form. This application form would not be enforceable in court. I have one exactly the same and the Co-op are long gone and their alleged credit card debt with them. Send Frederickson the Account in Dispute letter and they cannot add charges to an account in dispute. If the Co-op did not send you a Default Notice prior to termination or the DN was unlawful, the agreement has been rescinded which means it no longer exists and only the arreasr can be claimed but as there is no agreement there are no grounds for claiming arrrears. The Co-op DNs are usually unlawful ie do not give sufficient time to remedy the alleged breach of agreement. Relax - they cannot claim a penny on this and it serves them right for not issuing legal agreements.

    Thanks for the reply.

    Iam looking at the SARicon and the notes off screen and from what I can make out with there code they write in it seems that the defaul notice was pocessed on the 19/06/09 and the termination letter was processed 18/08/2009

    they also note that Phoenix letter was generated on 04.09.09 the copies of all the lettres that they have sent have no account numbers dates or any details of name Etc so have no proof that they were sent to me.

    I would be greatful if you could give me so lines to add or should I just send a standard account in default letter

    It's the Account in Dispute letter you need to send and you don't need to add anything to it. You are disputing it on the grounds they have failed to send you a copy of an agreement.

    I contacted Fredrickson Via their web site and sent them the dispute letter on the 15th as part of the message.
    I got a letter today saying that they have returned the account and reject the complaint.

    so thanks!! lets see who is next
