Ok the story so far....Im a tenant currently renting a house with my 'friend'.Stupidly, as he had a default on a previous debt i agreed to have only my name on the tenancy agreement itself with my 'friend' living there also with the estate agents fully aware he was resident at the address.Anyway we agreed that i'd pay the full rent amount and that he paid the bills and any discrepancies we'd sort out ourselves.However, I've now received a letter from the council tax office to state no payments had been paid for the 6 months we were living there and that a court summons has been raised for the full yearly amount along with bailiff costs etc. As my name is the only name on the tenancy agreement the council have stated I am the only person liable for this debt. Can someone please offer me advice on how i can actually place the debt back to him? Do i have a leg to stand on? or does it all fall to me to pay...?I'd appreciate any responses!! Good or Bad

I'm afraid you will be liable for the council tax arrears

 

 

no payments had been paid for the 6 months we were living there and that a court summons has been raised for the full yearly amount

 

if you only lived there 6 months you are only liable for 6months arrears

did you inform the council when you moved out of the property

Yes have notified them i've now left the property and have yet to respond.

 

is there absolutely no way around this? i.e. is there anything i can do to show he lived at the address to make him also liable?

you should only be responsible for the 6 months arrears the council will get a liability order against you make sure you ony have to pay 6 months arrears

no way around this I'm afraid

 

 

try to make an arrangement to pay xxx per week/month to the council before the bailiffs become involved (highly unlikely) however it shows your willing to pay

you should get a letter 2 weeks before its passed to the bailiffs (doesn't always happen like this) ask the council for a copy of there code of conduct for the collection of council tax arrears

always do everything by letter so you have a paper trail

 

any letters you send to the council keep a copy for yourself and send by recorded delivery or hand deliver and get a receipt

 

i will post more info regarding bailiffs so that you have a heads up on what they can/cant do

cant break into your home

cant get a locksmith and the police to gain entry (unless they have a valid walking possession agreement and you have deflated on payments)

cant have you arrested or arrest you

do not have to get a levy to accept a payment plan

 

 

under no circumstances allow a bailiff to get a walking possession agreement

 

 

 

1. ALWAYS! Keep your door LOCKED SHUT at all times. NEVER open the door to a bailiff - speak to him through a window or the letterbox

2. ALWAYS! Hide your car - in the garage or park it well away

3. ALWAYS! Take photographs of the bailiff and his vehicle, even better use a camcorder and video-record EVERYTHING

4. ALWAYS! Speak as LITTLE AS POSSIBLE and let the bailiff do the talking

5. ALWAYS! Ask for his bailiff's certificate number

6. ALWAYS! Ask which court issued his certificate

7. ALWAYS! Ask for a full breakdown of his fees IN WRITING

8. ALWAYS! Ask who the creditor is (if you don't know)

9. ALWAYS! Pay using a credit card, avoid cash and debit cards if possible

10. ALWAYS! If you have grounds, get an appeal lodged immediately (parking tickets) - it stops enforcement

 

1. NEVER! Sign any documents handed to you by a bailiff

2. NEVER! Phone a bailiff (unless asking him which Court issued his certificate)

3. NEVER! Admit any debt

4. NEVER! Say or "confirm" your name address or date of birth
