Hi, Just watch gmtv last week, and have been reading threads, and faqs ever since, anybody have any good advice on taking on RBS in scotland, have statements that i have kept for the last 4 years, charges of £3500 for the 4 years, so maybe around £5000 for the last 6. any advice will be appreciated, as i start out my journey. kevinjay27

No to make things seem harder, The SMALL claims court - FIXED FEE - You do not pay RBOS fees
Sm Claims limit is £5000, So whet I would do is Split the case
But we will inform you opnce you have your Full details on how much they have unlawfully taken

It's a much smaller limit for small claims in scotland so you'll have to get more advice of one of the mods in scotland, sorry i don't know who but one will be along before long though I'm sure

Is there anyone who has had a full settlement from RBOS, there does'nt seem to be anyone who has. if so can they tell me, how it went, and what the timescale was from start to finish.
They are dragging on a little...and in fact there are many in the court systems now.
Some are speculating that they are demanding confidentiality agreements the same as Barclays,however it is not compulsary to sign one.
The Halifax and HSBC etc are very prominent simply because there are a lot more of them.
I suspect we will see more written about HBOS cases,as they start to get settled quicker.

Hi, just a suggestion here, if the bank is asking for confidentiality, and no disclosure, why has'nt anyone taken this a step further, and ask more more money on top of their full settlement, they were quick enough to take our money, why can't we apply the same rules.

I think this is actually the case already.
But of course once they do that then they cant talk about the case ...........or the extra money for signing !!
No one should sign the confidentiality agreement unless there is some obvious benefit of doing so .....otherwise whats the point ??

Just to make sure i'm getting this right, i'm still waiting for a list of charges levied on my account, but have some statements, dating back 4 yrs.
I know i can claim for u/p direct debit and card misuse/position of sale, but what can i claim in regards to my overdraft, i have charges of maybe £20, for being over my limit, then interest charges on my overdraft of maybe £5.09.
Also doing some re-search on the charges schedule template, i understand the 8% on the charges, from the date you were charged, but do you include this in the pre-lim letter, then it's only the judicial 8% interest you include when you are actually filing your claim, from the first date of starting proceedings with the bank, ie, the date you sent your prelim letter. is this correct or am I getting it totally wrong.

Overlimit charges are penalties.
Do not quote 8% interest in a prelim letter,this can only be applied from the court stage although you can say that you will apply for it later.
A charge schedule should be sent with prelim and lba.
The 8% interest is claimable from the first unlawful charge (within the 6 years)

can anyone please tell me what you can claim back. is it just charges for unpaid direct debits, and card mis-use.
Or can you claim back charges for being over your overdraft, as this was mostly caused by them, taking off these charges of £30 at a time for unpaid direct debits.
Charges for unpaid cheques/unauthorised overdrafts/fees for cancelling cheques/charges for unpaid standing orders/dds/etc etc

Just wanted to make sure, i did'nt make a mistake, as i had an authorised overdraft, and was constantly being charged £20 a month in charges, due to being over the limit, i thought i could claim for this, as the main reason i was over, was due to their excessive charges, for unpaid direct debits, as if this was not the case, i would not have constantly been over my limit on my overdraft. would they not refund these charges of £20, if i could prove it was there unenforceable charges that put me in this position.
Hi before i send my spreadsheet, with my pre-lim, do i have to delete the calculated interest, and the total with interest, or can i just leave it on it, i have already stated on my pre-lim the amount i am looking for without the interest, just want to make sure, no mistakes
