Near where we live there is a cut(path) that runs between to streets with fencing either side.

Because the people who live on the otherside of the fence has not trimmed their bushes they are growing over and through the fence for most of the path and you have to stoop right down to continue on in the cut or go single file in some places becasue it has got that bad.

We rang the local council to say its practically impassable and they say because the street concerned is private property they cant do anything about it.

So where do we go from here, its really bad and very few people us it now because its like the krypton factor.

I not sure if this will really work, have your considered speaking to a local councillor (I always speak to the one with the biggest mouth) and ask them to intervene.

they are responsible to get the grower to cut it back

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

When our hedge was onerhanging too much, we got a letter from the County Council telling us to cut it back so it's worth a phone call to the County Coucil as opposed to the local council.

They can ask the owner to deal with it.

Section 154 of 1980 Highways Act gives local authorities the power to issue notice to householders to deal with OHV overhanging vegetation. Even if the footway is not a publically maintained highway, it will still be a public highway with rights of way and the council can issue an OHV notice to the property. Dont take no for an answer, it takes 5 mins for the council to print a standard OHV letter. most people act on receiving them.
