fredrickson international are saying to go back to egg
hi all,
i recently sent off a template letter from here requesting a cca for my Egg card to fredrickson international who had informed me that they had bought the debt from egg.
they replied pretty swiftly (in 3 days) saying that egg would send it direct and i had to apply to them for it.
so my next step? i would of thought if they had sold the debt then surely they could provide the cca??

Hi,
As they have bought the debt, they are responsible for supplying the CCA, not passing the buck.
They should ask Egg for it and pass it on to you.
Wait the 12+2 days then put the account into dispute

You need to tell them that the account is in dispute and to hold all further action on this account. You could ask Fredrickson for a copy of their Notice Of Assignment also.

hi, thanks for the advice, is there a template letter to put it into dispute and also is there a template letter asking for a notice of assignment?? (i hate being a noobie!!)
i did look in the link in ukaviator's reply but cant seem to find the letter putting it in dispute....?

Hi all, my Egg account has been handed to fredrickson international, with whom i have requested my cca only to be told that they cant provide me with one and to go to egg direct.
So, with advice from here, i put the account into dispute and sent it off (also enclosing the postal order i originally sent).
I have had a new reply from fredrickson international saying this:
Thank you for your recent letter.
We are unable to provide a consumer credit agreement. You will need to contact Egg direct with £1.00 fee for the credit agreement.
We have placed a hold on the account for 30 days awaiting your payment proposals.
and they have sent my postal order back.
So where do i stand now?
I have put the account into dispute with them and they obviously cannot supply me with a cca.

Hi,
In the link I gave you at post 5, there is also another letter when a DCA refuses to send the agreement (letter 13) but I would merge some of the CCA request into it.
If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties.
Report them to trading standards too
