    Default Barclaycard refunded charges to Hillesden - ??

    Hi would greatly appreciate any advice or opinions on the following.

    I had an account with Barclaycard against which they made numerous charges. Account defaulted and was assigned to Hillesden approx 3 years ago.

    About a year ago I persued Barclaycard for refund of the charges. Due to a bereavementicon I had to put the matter on hold until recently ie I received no money and did not actively persue the matter.

    Recently I wrote to Barclaycard who claim they actually refunded the charges plus 8 % interesticon directly to Hillesden.

    I received no notification whatever that they had done this and statements from Hillesden show no money having been received by them.

    I had asked for a refund by cheque in the original correspondence.

    Obviously i'll be phoning Barclaycard and writing to Hillesden, but wondered if anyone else has had something similar happen. I'm not convinced Barclaycard made any payment at all TBH, strangely enough I don't trust them.

    Hi Hound,

    Don't call BC - write to them so you have a paper-trail.

    Seek confirmation from BC of the exact amount refunded and then check to see if Hillesden credited it to your account.

    Also, send Hillesden a CCA request to see if they have your credit agreement, without which they cannot demand payment.

    Are you still paying Hillesden.

    For future reference, you should have reclaimed your charges PLUS interesticon at BC's contractual rate. They'd have refused to refund and you would have made a court claim.

    Once that was done, they would have HAD to refund to you direct.

    More work would have been needed re the court claim, court bundles, etc but the reward financially may have been significant if you had older charges to reclaim.

    No i've not been paying that lot. I did CCA Barclaycard before I started all this who sent an 'Application Form' posing as a credit agreement..

    Good point about writing not phoning. I nearly phoned BC today but am glad I didn't. Too keen to get my hands on the money I guess

    From what BC have said so far either they're BSing or Hillesden have had the cash (which apparently included interesticon i'd claimed at 8%) and not credited it to the 'account'. It all sounds very tenuous either way..

    Was it BC who said the charges had been refunded to Hillesden - did they tell you by letter or by phone.

    Yes it was BC, by letter. But the letter was a botched up pro forma to which they had added a couple of paragraphs which contradicted themselves as to how much and when. From someone in Barclaycard Customer Services.

    Could be they didn't look into in properly before replying. They say they made the refunds over a year ago now.

    I've written asking for clarification and told them if I find Hillesden had the money but did not credit it to the account, i'll complain about them to Trading Standards so they'd better get their facts straight.

    If they haven't refunded to Hillesden yet, you may still have a chance to start a fresh claim and include interesticon in restitutionicon.

    When BC refuse to pay, because of the interest, you can file a claim and get the refund paid to you direct.

    Gotta be worth a shot !!

    Good advice - which i'll follow.

    I know it's off-topic but what really makes me sick about the banks and cc co's (i've got five claims either settled or ongoing) is that it was our money in the first place. Lord knows how many people have defaulted on accounts only or in the main because of the 000's of £ of extra debt the companies themselves added to balances. Thirty quid in charges for an automated banking entry..almost half a week's money for someone on the dole (fortunately not me but there but for the grace etc)

    Cheers for your input and fingers crossed regarding Hillesden. Although i've not posted much on here i've used CAGicon hugely as a reference library - all the time experienced members such as yourself have spent is much appreciated, believe me.
