Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.

BAB v Barclaycard
Would appreciate any advice/opinion on my next move
Usual thing. In response to my s78 they sent a current list of t&cs saying these are the T&cs of [our] current agreement
Read a few threads [esp Minnimes and Two ticks] and i am aware of s180,cpr31 and SAR but just dont know which route to take
Its a big [alleged] debt and i anticipate litigation so i want my next letter to them to be judge-friendly
Any/all advice gratefully received
BAB
PS Stopped paying in April and no DN . Is this significant?
If you want to be pro-active and take the initiative, use the CPR 31.16 route. Don't start this unless you intend to apply to court after the first 2 letters.
If you are happy for this to take longer, wait for BC to reply to your Dispute letter, then complain to the fos about BC's failure to supply your credit agreement. There have been recent cases where FOS intervention HAS produced agreements.
I wouldn't worry too much about letters being "judge-friendly" - just do what you have to do.
Are there penalty charges or PPI on this a/c that can be reclaimed to reduce what you owe to BC.
