Hey guys, Im very familiar to "reclaiming charges back" game - as ive been fighting Shabbey and Crap 1 for 2 years. Now my focus has turned to helping my parents who are having lots of trouble.
They are being charged by Abbey Every month between £150 and £280~ for the past 1-3 years. Ive not looked at all the paperwork yet to fully get a grasp of it. Now, The reason being - They literally have more coming out each month then they do have coming in (hence high charges). My dad seen the guy on ITV about hardship and gave it a try. Me and him thinking he was - ( i know you need to qualify for it, or along them lines) So he sent the Template letters etc about claiming hardship and they have basically rejected it and said we do not accept this and we have folowed the Banking Code (or along them lines).
Now, ive got some fantastic template which I have used to get my charges back etc, Im just wondering, CAn Abbey do this? As i was aware, they take into account how much you are stuggling to pay the bills. (they are, clearly going overdrawn - on there overdraft (every month)) -
Now, what steps should I take here. I know i need to sent Subject to access request etc, Should i just use the standard letters (long time waiting) or push on the hardship claim?
Yeah, near enough everything is behing. MY dad has jus got swine flu so he cant work now for week. They are panicking thinkin they may loose house in a few months. DCA calling up 10-20 times aday (im gong to send harrasment letter etc), ""Im sure i heard, something about them being summoned to court as well for council tax? ill let you know""

Do they still use the Abbey account?
Do they still incur charges today?
Are any of the arrears being paid off?
Furthermore, have they approached the mortgage provider and stated they are struggling?
What caused the issue of not having enough funds to cover their outgoings ie loss of job, loss of hours, etc, etc, ?
They have managed to open an account with Barcleys (dont know if theyare any good Never been with them) so they are closing the Abbey one soon as possible. But they did get a letter few days ago saying they would be charged again.
They have had the mortgade reduced slightly & it is not having enough funds to pay the outgoing Bills, when I send the Subject to access request to abbey, i wouldnt be supprised if its over £3000 in the past 2-3 years alone.
THey should be slightly better off now starting a fresh with Barcleys, BUt they might just end back up in the same position but with them. THanks. rob

Are they in arrears with the mortgage, council tax and/or utilities? Or are they up to date on payments?
The council tax, they recived a court summons for what they need to pay, THe mortgage is also behind /rob#edit# And the utility bills Just paid before cut off etc

ok, so currently ticking boxes at the moment. Next question is what caused the drop in income that lead to the bank charges?
Furthermore, have they already had a good look at their non priority creditors that they pay through direct debit and tried to get rid of unnecessary payments?
It was my mother hours which got reduced so that droped some income. They have stopped the non-priority DD's which did help a little but not a great deal. I will get a list etc of exacly what they pay at the moment, there monthy income and the total outgoings

Then that is your argument with the bank. Total charges, financial hardship, lifestyle event ie mother, charges lead to reduced budget and therefore arrears.
I would hope that they may look at an interim payout based on that specific argument.
